I recieved my letter today. Are they calling our bluff cos at the bottom it states about the risk of court fees also being included - if they predict court as an option then do they think they are legally right in all this, or is it just part of their scare factor?0

hi pete1210, yeah we found that funny too. Our solicitor assured us that it's just a scare tactic - a very poor one at that!
Angreylisa, you can't delete anything from your credit history but you can make a statement on there to counteract anything they're implying.
Whilst pete1210 has kindly given you the address to all "three" companies you'll soon find that Fitlife Ltd and AMC are one and the same company. We found out this from the OFT who stated that "the complaint was against Fitlife Ltd trading as Associated Members Club". We wrote them (AMC) a letter stating that we won't be sending two separate letters to the same company, but from now on we will be dealing with the AMC only on this matter. So far it's worked.
It'll be nice when we come home to find that we have no more letters from these people - they're starting to get boring!0 -
I've been caught up in the same since Feb/March (It was so long ago I cannot remember without looking at my paperwork) I have posted on here before
I have been ignoring all letters from the above for the last few mths, because I was getting no where. They ignore the fact that you haven't used the membership, and that you wish to cancel. I did send Fitlife a cheque for the outstanding monies (a while back) but was advised to cancel it with my bank, I did so, but then on receiving my statement, I saw that it had been cashed :mad: I rang my bank and it was human error that they didn't cancel it, the re-issed it. I was NOT happy!! So Fitlife have had approx £30 from me.
Today 22.09.08 I have received a letter from Empingham Resolution & Negotiation....I'm yet to look into who they are!? It says I owe £500.03 (I'm yet to check this amount) under the consumer credit act. It says that Fitlife have instructed them to pursue the debt. It states that if you dispute the debt they would be happy to discuss this in an attempt to bring this issue to a satisfactory conclusion. I will check them out first then get on the phone (more of my time and money on this very annoying issue
One of the things that I do wonder about is that the 'said' gym that I can use with the membership haven't chased me to attend, nothing from them at all apart from a reply to one of my many letters that I included them in on, saying that they cannot cancel my membership and that I would have to get in touch with AMC.....AMC then advise that it's not them it's fitlife....and Fitlife say it's not down to them and to contact AMC......!!!!!! is going on? Who can cancel this!!!

I have had a second letter from Empingham, after refusing to speak to them on the phone. This time they say that they will be "advising their client (Fitlife etc) to instigate legal proceedings or door step collection activity."

The first letter I had from AMC came on the 2nd June 2008. In it they said that the credit agreement was with Fitlife and was non-cancellable. They also said that the agreement came with pre-contract information sheets (plural). If it did, I did not see one, and I haven't got one. One may have been flashed before my eyes, but if so, too quick for it to have registered.
I was also given the impression, by the rep, that I could cancel if I found that I couldn't continue with the exercises. (I did pose that question at the time of signing, as I have quite a few health issues).
In any case, has anyone noticed that the amount they are requesting, £500.03, works out as being the amount due for about 3 years and not for the 2 years as stated on the contract. ( I had paid some by Direct Debit before cancelling).:mad:0 -
JaayGee: My letter from Emphingham also stated an amount of £500.03. I did wonder where they got this figure from. They can BEEP off if they think I’m paying any of them a penny let alone more
I’ve had no more letters but a Private number was calling me tonight so I picked up because sometimes my bf’s home number comes up like that, and guess what…it was a woman called Cathy at Empingham. Saying she has received my last letter that said I was in touch with the OFT (office of fair-trading) and asked if I’ve had any response from OFT, I have not and said so. She wants a copy (via email) of what I get back from the OFT then she can get in touch with her client (Fitlife) and put a hold on the debt collection (for how long I don’t know) She also said that I’m not due another letter from them demanding anything for a few weeks
That’s it so far, tomorrow I will be getting in touch with Trading Stds and see what the OFT have come back with (I really hope they kick A** on AMC, Fitlife etc for all of us innocent people)0
