Dear Sir/Madam

Thank you for your letter dated 17th October.

I have disputed this apparent credit agreement with the companies involved as I believe I was mis sold the Credit Agreement & I was led to believe I was signing for insurance to use the gym equipment.

They also say I have signed a non-cancellable pre-contract agreement but I was never shown this before my signature as My "Pre Contract Information sheet" was in fact hidden as a copy under another copy and it was carbonated through onto the piece of paper on the top agreement, so I wasn't aware that it was there.

I have contacted all 3 companies ( Fitlife Ltd t/a Finance for Fitness/ Lyle Hill Ltd/ Associated Members Club ) with a formal complaint letter regarding this apparent credit agreement.

I've given Trading Standards a statement & I am in touch with the OFT (office of fair-trading) regarding this.

You should note that any enforcement action taken by you in relation to this disputed account will be vigorously defended and contested.

I WHIS ALL COMUNICATION BY WRITEN LETTER.

Yours faithfully,

hi everyone. ive just moved some weeks ago so i have been really busy. i am still in contatct with the people at my old address so i still able yo receive my mail, as i have not told fitlife of my move, and i have no intentions of doing so. i received my 2nd threat letter from eplington yesterday telling me they would add on court cost if i didnt respond to there letter.
HELLO just cut the crap and take me to court.
they may find me one day but who cares. im still here for you all fighting the good fight, and if we all stick together we will WIN.:T

Hey I just moved also. I asked my TS officer if I should tell them - he said that Empingham would find me eventually He suggested if I told them my new address then at least I kept honest at my end...I beg to differ sometimes though, knowing I could shrug them off possibly.

• Hi All,

We had a letter from Empingham last Wednesday. My hubby spoke to them very calmly on the phone to explain the situation. They reassured him that they are at present investigating Fitlife etc to see if the debts are viable.

They can't take us to court, it'll cost them more in fees, it's just not worth it.

I don't know about anyone else, but i'm sooooooo bored of this. I want it to be over so badly! I've been so stressed, don't know how much more we/I can take.

My solicitor is on holiday at the moment, i'm due to call her tomorrow. I'll post an update tomorrow to let you all know the outcome.

xxx Keep fighting the good fight!

Sorry to hear that so many of you have been badly treated by this bunch of crooks. Scams like this are really nasty.Whenever I get anything like this in the post it goes straight in the bin.If I am feeling particularly vindictive, I pop their literature into the prepaid envelope of another company also offering me something I don't want and vice versa so that it costs them for the priveledge of receiving each others mail.My friend has even resorted to wrapping a brick and attaching their prepaid envelope to it before posting it, thereby ensuring that they pay through the nose for the postage!!!At the end of the day, if it sounds too good to be true - it probably is!Hope everyone affected by this, does not suffer financially.Strumpet

yeah agreed! my wife's second membership (the one she signed on my behalf) has only just started with the boring letters from Lyle Hill...here we go again!
I've just moved house & work all hours under the sun with 2 young children, etc, etc - dealing with this hassle is the least of my worries yet at the same time rather disturbing!

I can't even be bothered to contact them anymore!
• Hi All,

According to my hubby Empingham wants proof that we have spoken with Trading Standards - so we're just preparing a short letter with copies of the correspondence.

I spoke to my solicitor yesterday. She pointed out the fact that it won't cost these people very much to sue us - about £30. So she can't understand why they haven't to make an example. She then said they probably haven't done so because they know it's not a viable case. She suggested that we respond to them by providing proof, and then just leave it.

Arrrgghh, I sooooo can't be bothered with this - i've got more important things to worry about! I wish they would just get it over and done with. Bring it on.

You're right pete1210, we all have other commitments - we all work our back-sides off, and for what.....to be treated like this!!! It makes me sooo mad!

P.S. pete1210 - I hope your new house is going well. :)
• We have been aware of these companies for some time. They have never or will never take anyone to court as the risk of a single court loss will expose the scam. For every 1 unhappy member there will be 100-200 or more people that will pay up. Its a numbers game for them. So be happy that they will not take you to court. If you want to help others write to the local papers (local paper of where office is based) stating that in there area a scam company is operating. This may create a local reaction that will drive them out or make them provide proper contracts. Copy internet links to the local paper. Remember they will not take you to court.

The address for FitLife is exactly the same as Lyle Hill,

53c Manor Road North,
Itchen
Southampton SO19 2DT
• relaxplease - Good idea about the local newspapers in the Southampton area.
• Hello, I have to say I feel a lot better finding this forum as much the same I and my huusband are going through the threats right now as a result of joining during april in the same way. We signed up and it was all a rush with the heading of the agreement under the clip part of a clip board, did not get time to read it as the guy had other people waiting, and yes signed up for a DDebit , so we thought! I expressed my concerns to my husband some weeks ago that there was something strange about all of this following the request to cancel and Lyles response.
On visiting the Gym they too were really vague about the whole agreement thing as they do not have contact with the AMC.
After Lyle told us that we could not cancel and that we would have to pay they also still kept out membership cards which I had returned to them in the original request to cancel.
Lyle say they cannot help it's the AMC, then the AMC say it's FitLife and after requesting fitlife details the address states: PO Box 90, Gloucester BUT!!! the phone number was that of LYLE in Southampton.

I spoke with consumer direct and did not get much of a response and suggested I try to compromise with the club. I dont think they fully understood.
Some advice would be good here.
