If you haven't already - I would suggest escalating the PayPal Dispute to a Claim so that Paypal can start the proces of dealing with it.

I really hope this works out okay and you get your money back (or the mattres is delivered).

Hi Daisy I have 20 days to do this and the bloke is supposed to be back from Spain today so I am going to see what the weekend holds. Imagine the egg on my face if he comes back and arranges delivery right away. Scrambled egg would never taste so delicious. Sigh

I wouldn't worry about egg. You are not in the wrong. You paid and he didn't deliver - you are well within your rights to escalate. All he needed was to communicate with you - which he didn't. I think you have been very patient and understanding up till now and I don't feel this seller deserves it. If he delivers the bed or refunds you - then you can always close the claim - no harm done. By escalating to a claim you could also prod this slacker into action!!

So do you think I really should escalate to a claim and not wait for him to come back from Spain? I guess I am too trusting and being the people pleaser that I am not asserive enough. I did not even put the dispute in until yesterday but did not understand why I should have done it sooner. So to escalate to a claim what do I do? This is all so complicated thought I was doing pretty good to be able to use ebay for a senior. Not thinking that now

I am daft you know. Many years ago new to ebay I listed 5 small makeup items and when it said how many items do you have I put down 5. Started the bidding at a penny. Then I realised that 5 people were bidding for the items as if I had 5 lots and I tried to close the bids and I couldn't. I wrote to all the bidders expaining that i only had one wee parcel with 5 things in and several took me to claims. Even tho I explained my error and my newness. They were still demanding that I find the 5 items for them at that price. Most were great but there was about 30 bidders to contend with. That was for a penny and they took it to claims and here I sit worrying to do it for £375. Someone give me a swift kick up the aspidestra will you? Taffy

I have been reading this every day and I do feel really sorry for you with what you are going through. It is a lot of money if I sell an expensive item I communicate with the buyer, its not hard to do, even from Spain the buyer could of accessed the internet or got your number to call you, at worst he could of asked somebody else to call you. Even if he comes up with the goods he needs to understand that taking someone's money then disappearing is wrong. Hopefully the goods will arrive and he will think twice about doing this again.

Continue with the claim, you have the chance to write your message on there, you can start by saying that you have had no contact from the seller since he went to spain and that you are feeling a bit worried because of the value of the item, there;s no egg on face if he is decent he will apologise and be understanding. If he's a con then you will feel better knowing you did something sooner rather than later.

    Good luck.

    Taffy,

Promise me that if the seller contacts you tonight saying something like 'I left it with my brother to sort out - leave it with me and I'll send it to you on Monday' that you WILL STILL go ahead with escalating the claim.

You can always cancel it when the bedding arrives. In the meantime, it will spur the seller on.

Thanks Kay yes I think I need to do that and should have done it a week ago. I didn't understand when I read paypal's instructions the importance of all of this. Daisy has told me too that I need to take this to the next level and get paypal involved in this. I am understanding now a tad too late how paypal works.
Thanks for being such a wonderful bunch of people. My ole partner God bless his cotton socks, never a bad word from him, says "it only adds up to all the money that you have saved on Martin Lewis. So you win some you lose some. " Trouble is he is the one that loses out on the bedding (not that I wouldn't be cuddled up right beside him of course.) Oh well it has helped to vent on here and get some sound advice.
Will let you all know what happens next.

Well Friday is nearly at an end and tears run down my face at my foolishness. I have filed a claim with paypal but I have probably lost all my money. I have heard nothing from the character that was supposed to be in Spain and which I stupidly believed. Why am I so gullible? To every mistake in life there are lessons to be learned I guess and that is what gives us substance. I even wished him a good holiday when I heard from him!!!!!!!!!!!!!!!!. Thanks for all your help folks.

Taffyscot, can I please just confirm that you have opened a full chargeback and not just a dispute?

Hi Soolin, I hope that I have. I opened a dispute and then it said to put in a claim you must confirm that you have not had a satisfactory reply from the seller and put a reason into paypal why you want them to investigate it. Soo I will pm you the thing I wrote to paypal and you tell me if it was ok. The seller still hasn't contacted me and now I suppose he was stalling for time getting his account cleared out. I really did not realise this when I didn't claim sooner, stupid me. If you lot hadn't told me I still would not have realised the difference as paypal do not explain this very well unless you have done it before. Taffy
