As long as the seller still has a valid credit card and bank account registered with their Paypal account, then yes they can just take the payment. This is why the buyer needs to lodge a dispute as soon as possible before they change any details.0 -

Darn it I wish I had known that. The seller is supposed to be going back from Spain tomorrow. I still haven't opened up a dispute. I guess I should do it now. Tim and Sooney I will pm you with a copy of the expired listing and anyone else that wants me to. I do not want to put it on here because it is too long and it is a public forum. I cannot just send a link as the listing has expired but I can copy and paste it into your private pms (i think) When I had read the paypal dispute thing it said that you can open a dispute up to 45 days from the payment received but that would have to be settled 20 days after that and after that could not be re-opened. As I am a novice at all this I thought I would wait until the seller is supposed to be back from Spain and then start a dispute if no joy from him.
I did not know that paypal could get anything back out of his account or his credit card. Ok will send Tim and sooney the listing and if anyone else wants it will try and pm you. Taffy0 -

I don't want to worry you, but this isn't guaranteed. Please be ready to open the dispute as soon as you think he's not going to cooperate further.My TV is broken!

I would open a dispute personally as it's a lot of money to be messed around with! A lot of people would of stepped on it straight away. Please please don't leave it too long before you do this.:rotfl:0

I hate to say this Taffyscot, but I think you may have been done. Start a dispute immediately.
They don't even have a photo of the mattress on the listing, and the feedback they do have is for items they have bought rather than sold except for one neutral feedback for the same item that you have bought.0 -

I did think that they didn't have a photo of the mattress but thought as it was still all wrapped up they wouldn't have a photo would they. That's one of the reasons I thought it was genuine. We saw a mattress and beddng shown in Spain and they warned that once you opened the box for the mattress you need to be in the actual room for the mattress as it expands then and takes on the foam shape. That is why I thought there was no photo.
Also even tho not much feedback I thought that since they had an account for a while and maybe did not use ebay very much. Also they said on one of the listings that someone could pick it up at their home. Stupid me of course not realising that they could give a wrong address. ok off to do a dispute but I don't hold my breath. Sigh I hope my quidco pays out really soon fat lot of good it will do tho. I have a mobile number for him is that traceable at all?

I agree with what Tim has already said, no photo and no selling feedback except a neutral for refusing to sell this mattress previously. Yes Soolin I was thinking that they should have taken a photo of the boxes too now but that is too late. The negative feedback for the mattress that he withdrew because he did not put a reserve on the first listing was not on there until after I had negotiated for the mattress. He is supposed to be back today so I wonder what will transpire today. I have put in a dispute but I do not hold out for much. I feel foolish and I feel exploited and vunerable but then it is my own fault. Most of all I feel disappointed that our hard saved money is not going to be used to give my partner some relief from the terrible pain and cramps that Parkinson's disease can inflict on someone.
This was the 3rd time that he listed the bedding and I should have listened to my gut as soon as I saw the photo I thought what the heck is this. Having seen the bedding itself tho in Spain I was taken in by the fact that I had wanted this bedding for him for 4 years but could not possible afford it. My gut said no but I think my greed for getting this at a good deal said yes.
I did also wonder why other people did not bid very much on this item since it appeared to be a wonderful deal.
I wonder what the world would be like if we all had hindsight. In hindsight I wouldn#t want to know what the world would be like lol.

Hi does anyone know if it helps to have their mobile phone number? Can this be traced at all by the police if this is fraud or am I grabbing at straws? Do the police do anything if people have deliberately defrauded you out of money or do they not bother? Sigh this is the day he said he would be back from Spain I guess today will show if he replies again. Taffy0

If you haven't already - I would suggest escalating the PayPal Dispute to a Claim so that Paypal can start the proces of dealing with it.
I really hope this works out okay and you get your money back (or the mattres is delivered).
