My question is what do i do next? i have no knowledge of this debt i have sent them the letter asking them for a copy of the Credit Agreement along with the £1 PO. am i under any obligation to provide them with anything until they send me this supposed credit agreement.
You have absolutely no obligations whatsoever to divulge any personal information. Indeed the legal onus is on AK, to provide you with the true copy of the original signed cca - and the 'clock is ticking'.I am NOT, nor do I profess to be, a Qualified Debt Adviser. Keep the letter - but don't reply. Once the 12 working days have expired (allow an extra 2 days for post), send them the letter, courtesy of weller711, that you will find on the following link:

In the meantime, you should consider all other communication from them, both letters and phonecalls, as harassment - keep all letters and 'log' any phone calls, so that you can report them to Trading Standards as they are in direct breach of the OFT Debt Collection Guidelines:

the letter you refer to does not seem to apply as it seems that the letter in question is the one to send at the start of the process not 12+2 days.

HELP! two weeks ago i recieved a letter from Debt Managers telling me that i owe AK £264, there was no mention of who the original debt was supposed to be with. So i sent them the letter copied from thgis thread, the one not acknowleging the debt and asking for a copy of the original credit agreement, and today i have recieved a letter from Debt managers telling me that "we are no longer dealing with this account. your communicationsahould be forwarded to our client direct.
I also recieved a letter from AK. which says

it seems they are getting wise to peoples letters and are changing the way they do things. they are not letting on when this debt is from so i can't send the 6 year letter yet.

Play them at their own game. Send them the 6 year letter. If you are right they will not reply. If you are wrong they will reply. i have just got off the phone from AK, spoke to a horrible little man who tried to tell me that AK were under no obligation to supply the CCA as they were not the original creditor. is this true?0

Yesterday I received a letter from Russell + Aitken which goes like this;
Creditor :AKTIV KAPITAL F1
Client Reference :xxxxxxxxxxxxxxxx
REF :XXXXXXXX
BALANCE DUE : £462.02
We have received instructions from Debt Managers Ltd to proceed with immediate Court action in respect of your account.An application is shortly to be made to the Court for a Warrant to serve proceedings on you and in terms of which the Court will be asked to make an award of expenses and interest against you in addition to the balance shown.
We are sure you will want to avoid this action bearing in mind the extra expenses and the fact that your credit rating could be seriously affected.
We are therefore writing to you in advance of service of the proceedings to give you a final opportunity to make contact with Debt Managers Ltd if you want to avoid the action refered to above. Conyact can be made by telephone on 0870 050 1041 or send payment to Debt Managers Ltd, PO Box 168, Edinburgh, EH3 6UP.
No further intimation will be sent to you in this respect and this letter should receive your immediate attention.

I have already written to AKTIV KAPITAL that I do not acknowledge any debt to them or any company in their group. I also sent them (AKTIVE KAPITAL) a letter 14 days later as they did not respond to my first letter, so to get this letter was a shock. What is my next move and what do I do.Any help would be gratefully received, many thanks in advance.

Hi WEEGIE - was the 'letter' that you sent to AK a request for the true copy of the consumer credit agreement?
If so, then you should ignore the letter from Russell & Aitken, as this would appear to be a 'tactical' letter in order to draw you away from your rights, and AK's legal obligations, under the Consumer Credit Act 1974. In which case, in the unlikely event that AK/R&A do issue a county court claim, then you should put, as your defence, that you have requested a cca, which has not been provided within the legally prescribed time span, as defined in the Consumer Credit Act, 1974.
If the letter that you sent to AK was not a request for the cca, then you need to send them one now (with a copy to Russell & Aitken).I am NOT, nor do I profess to be, a Qualified Debt Adviser.
