Aktiv Kapital (UK) - Who Are They?

3kids&thecat wrote: »Hi guys,
Just been sent ANOTHER letter straight after the poor reply from Aktiv concerning the SAR.
They basicaslly said we have missed making the next due payment and if we do not get in contact to make one, the agreement we had will cease and the whole amount owed
(£10447.04) will become due and payable.
It's all getting a bit scary and stressfull.:(
You need to report them to Trading Standards.
Are you talking with one of the Debt Counselling Charities, such as National Debtline - 0808 808 400, CCCS - 0800 138 1111, or your local CAB?
They will be able to advise on how to get these leeches off of your back and may, even, write to AK on your behalf.
You don't need this stress. :mad:I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

Hi rog2.
Yes, I rang National Debtline again yesterday and told about Aktiv's replies. They said I must write back and say that the details sent for the SAR are not satisfactory and unless they provide definite proof of the CCJ and which court it was issued from I will not be making any payments to the debt.
Also I am to remind them that under Civil Procedure Rules they must apply to the court to enforce this debt.
I know it sounds a bit repetetive but if my ongoing experience helps give someone else the courage to fight then it's worth it!
I have had enough  but the battle must go on!0 -

This is exactly what scum like AK rely on, 3k&tc, that people give up because it is too much like hard work, but you must do what NDL have suggested.
Hopefully, as more people take on these 'chancers' they will, eventually, get the message.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

I have now received a letter from 'Call Serve' threatening me with on the door debt collectors or a county court judgment.
They are chasing after the wrong person! A) I know that I don't owe this money, b) they have got my surname and forename right but the middle name is wrong (alas, I have quite a common name but at least this proves they really are barking up the wrong tree and c) they haven't even got my correct address... the first line is right but the rest is wrong, including the post code.
My quandary is thus.... I want them off my back but I am loathe to contact them and confirm any of my correct details with them.
I'm an accountant so I know where I stand. My father, who is a solicitor, has offered to write them a pretty firm letter from a legal point of view but I don't want anything about me on the files of these people.
What do other posters think? Thanks in advance0 -

That sounds like an excellent idea, Saz. No doubt your father has informed you of your rights in dealing with these thugs, and how they should behave.
Just in case - you should be aware that, should a 'doorstep collector' appear at your doorstep, he will have little, or no, legal powers whatsoever, other than to enquire if you are the 'alleged debtor' or not. He will have no legal right of entry to your property and must leave immediately when you ask him to.

I agree with rog2. If you have a solicitor in the family then make full use of them.
Your father will probably also be aware of your right to demand that Aktiv cease processing any of your personal data under 'Section 10 of the Data Protection Act 1998'.

HELP! two weeks ago i recieved a letter from Debt Managers telling me that i owe AK £264, there was no mention of who the original debt was supposed to be with. So i sent them the letter copied from thgis thread, the one not acknowleging the debt and asking for a copy of the original credit agreement, and today i have recieved a letter from Debt managers telling me that "we are no longer dealing with this account. your communicationsahould be forwarded to our client direct.
I also recieved a letter from AK. which says
We acknowledge reciept of your recent communication, the contents of which have been noted
In order for us to further our investigations can you please provide us with all of your previous addresses since 1993
Please note that any information sent to ourselves is purely to ensure that we comply with the data protection act and to assist with our investigations."
My question is what do i do next? i have no knowledge of this debt i have sent them the letter asking them for a copy of the Credit Agreement along with the £1 PO. am i under any obligation to provide them with anything until they send me this supposed credit agreement.
it seems they are getting wise to peoples letters and are changing the way they do things. they are not letting on when this debt is from so i can't send the 6 year letter yet.
Please help0
