hi I've just joined the sit because i've received a letter from activ kapital for £1923. it arrived at an address that i lived at over a year ago and was passed on to me, is it worth ignoring it until they find me or should i reply in some shape or form. any advice would be grateful.

Hi Weggie and everyone else who are unfortunately have these VULTURES on your case.
We have been hounded by Aktiv for a debt originally with Barclays.The original debt was £50 now £250+ due i suppose to charges added by Aktiv. We have always vowed that we would never pay due to the appalling way we were treated by BARCLAYS.
We have rcceived countless threats by post from Aktiv rangeing from court action, to sending represntatives to our home and even to our places of work YEAH RIGHT LIKE THAT WAS GOING TO HAPPEN.
We have had all the usual B***SH*T from them regarding DISCOUNTS if you pay NOW!!!.
We have received countless phone calls, we have told them politely but insistantly that we have no intention of paying them a penny, Recently we have been subjected to a call everyday, three days ago i snapped, no i didn't agre to pay i got very agressive towards the women after she refused to give me her full name. I told her unless i got her full name i would not speak to her she refused again.At this i lost it every time she tried to talk i told her to FOXTROT OSCAR. She told she had heard it all before,i told her i could get more abusive to which she replied carry on,
whilst i am not proud of what i asked her she told me she no longer wished to speak to me and rang off. We have heard nothing from them since.
We have realised since reading this forum that the debt is 6years barred anyway.
PLEASE PLEASE DO NOT BOW TO THE PRESSURE THEY PUT YOU UNDER IT IS WHAT THEY RELY ON.

Hi All, am new to this forum :j
Have been reading this thread with great interest, and thought I would start adding my own past (present and future) experiences with Thames Credit (and also gratefully request any pointers from those of you that can help :beer: )
The story so far:- I ran up a debt of 6k with Barclays in the early part of the decade (the stupidity of youth etc)
- Said debt was sold to Thames Credit who I was paying £25 per month to, on and off, for about the past 24 months
- There was no record of this debt on any of my Credit Reports (and I'd received no Default Notice from either Barclays nor ThamesCredit)
- Got turned down for a Credit Card by my own bank, who told me there was an 'irregularity' on my Experian file (despite nothing showing).
- Phoned up Experian to alter some linked address information and a big red 8 DEFAULT popped up from out of nowhere relating to the Thames Credit debt dated March 2004.
- Phoned up Thames Credit yesterday and negotiated a 4k repayment to settle the account.
- Account now paid and closed. Just waiting for the paperwork and it to show up SETTLED on my Experian file.
However, the reason for this post to say that I fully intend to get the default removed from my credit report now that I have settled the debt.
So I thought it might be useful to anyone in the same situation if I posted my correspondence here.
Firstly I have to wait for all the paperwork to come through and it to appear settled on my account (I don't want them withdrawing their settlement offer or not notifying Experian that the account is settled, just in case).
Secondly, I intend to write a recorded delivery to the Thames Credit Company Secretary (using this template kinding provided by SurlyBonds here: http://www.penaltychargesforum.co.uk/showthread.php?t=32852&highlight=chrscmbs )
This should take a couple of weeks. If anyone has any other suggestions as to how I should take these rascals on head on in the meantime, please say.
I think for all of us it is about setting precedents legally. If a few of us can get settled defaults removed from our credit files then ultimately we all will. :T0 -
Oh and I forgot to say, part of the original debt with Barclays consisted of unreasonable bank charges which I intend to claim back - and I have every intention of taking that all the way to Court. I don't need the money back, just the idea of sending Bailiffs round to my old Barclays branch is what spurs me on there.
It would also be interesting to see if Thames Credit are legally liable in that case, or at least how they would respond to being cited in it.
Perhaps it could be used as leverage to get them to remove the Default from my Experian file?0 -

AFAIK Just because you have paid the debt off does not mean that it can be removed, you still have a CCJ.
I hope that someone says that Im wrong.

You did exactly what you should to these bunch of cowards. I have done the same, many times. Just give them abuse! That's how you treat scum, like scum. Hi guys! I haven't been on for a while but this is an update of the latest replies from Aktiv since my last letter telling them the info they sent was not solid proof of a CCJ against OH and that he would not be making anymore payments till we had some.
They said (summary) - They have noted the comments made and we are to note that as the CCJ was registered prior to Aktiv being assigned the account we are to refer to the courts with the (paltry) information provided.
Much the same as the original reply.
Next we got another one of their letters asking for payment *Blah *Blah *Blah
Today I phoned National Debtline again to update and I am now sending them this letter:

Dear Sirs,
Thank you for your letters dated ******and *******respectively.
Once again your company has failed to present me with a true copy of the CCJ, Case No: ***** - ***** County Court – Judgement Date: ******.
If your company does have a true copy of the CCJ in question and does not forward it to me they are deemed to be breaking their duties under the Subject Access Request procedures.
As no satisfactory evidence has been provided I take this to mean that your company cannot supply me with the proof requested.
With regards to this CCJ the burden of proof lays with the creditors – Aktiv Kapital (UK) Ltd.
I would like to re-iterate that under Civil Procedure Rules, Aktiv Kapital (UK) Ltd would require permission from the courts to enforce this debt.
I respectfully request that Aktiv Kapital (UK) Ltd supply me with a copy of their complaints procedure.
I would also like to point out that Aktiv Kapital are duty bound to supply me with a copy in accordance with the Consumer Credit Act 2006.
This is an official complaint and I give you eight weeks to provide me with a satisfactory resolution.
After the eight weeks has expired, if Aktiv Kapital has not provided a resolution, I will take the matter to the Financial Ombudsman Service.
I will also write to the Office of Fair Trading, raising the issue that I feel your organization is unfit to hold a Consumer Credit License.
I look forward to your reply.

National Debtline advised that it was highly unlikely that they will persue the matter as they need to provide solid proof of the CCJ to apply to the courts to enforce the debt.
With no solid proof, Statute Barred once again comes into play. In which case they can no longer chase the debt.
Also for anyone interested, I took it upon myself to write to the Registry Trust Limited (did this over the internet www.registry-trust.org.uk) Fee 8 pounds.
Received their search on OH which said: Nothing Registered (YAY!)
For the fee paid they search back 6 years for any Judgments, Orders and Fines for England and Wales. Also has similar registers for British Isles and Eire.
I'm feeling better and better about this each day. For anyone reading this,
thankyou to all who helped so far and those about to take Aktiv on *GO FOR IT!!!*:D0
