    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    After writing to the above two companies stating I do not acknowledge any debt to them, I received the following two letters. First letter from P.I.B
    Re AKTIV KAPITAL FIRST INVESTMENT
    Reference xxxxxxxx
    Client Reference xxxxxxxxxxxxxxxxxx
    Amount due to be passed for investigation£462.02
    Your account is in the process of being referred to this office.
    As you have failed to make arrangements for payment of the above account we have been instructed to open enquireies into your current financial position, If you wish to avoid the commencement of our enquiries you should call Debt Managers Ltd on the number below


    0870 050 1041
    Should you fail to call DEBT MANAGERS LIMITED within the next 3 days your documents will be passed to ourselves or a doorstep collector. We will arrange for a visit from a collector or one of our trace and audit investigators will be instructed.
    This amount will remain registered as an unpaid debt in our Investigation Bureau until your account is paid.
    New Investigations Co-ordinator
    This letter is similar to the one Ayrshire got.
    The letter from Aktiv Kapital/ Debt Managers is as follows
    We refer to previous correspondence and write to advise we have requested a copy of the signed agreement and will revert to you once this is to hand.

    My query is Should Debt Managers not have a copy on their premises?
    I think I will just ignore the above letters and wait until 42 days have passed .
    I just thought I would update everyone as to the progress of my last post.
    I am just wondering how many companies are involved with Aktiv Kapital, so far I have reached four.:rolleyes:
    Like good food and drink?

    AK/RussllAitken have acted wrongly by passing your details to Debt Managers, as you have disputed the debt. You should report them to Trading Standards for doing this.
    In the meantime, in the most unlikely event that a 'doorstep collector' does visit you, be aware that that person has no right of entry to your property, you have no obligation to discuss the debt with him and he must leave immediately when you ask him to.

    The letter is not worth the paper it is written on.

    First post on here. Found this thread after googling Aktiv Kapital. I received a letter from them saying I owe x amount. I didnt know what it was for and had never heard of them before but after reading this thread its seems likely its for an old Barclays debt. The last time I did anything with this account was, I believe, in 1998.

    Whilst I want to go down the stature barred route I am very worried about ruining my credit rating and am considering just waiting for the 25% reduction letter and settling to have it done with. I have worked very hard since the bad old days and am incredibly careful about finances now.

    I guess I have two questions:

    1) Is my credit file going to be affected regardless of what I do (nothing on there yet)?

    2) If I go down the statute barred route, will that likely lead to a default notice on my file?

    I realise this is how they operate and I will be falling in line but I really dont want a return to the sleepless nights and fear of people knocking on the door etc.

    Any comments on experience would be gratefully recieved.

    PS one last thing, if I ask them to prove the debt is mine, will that also increase the chances of a adverse entry on my file? i.e. can I delay for a month or so without fear of ruining my file?

    PPS. God, I sound paranoid dont I!?!?

    The default has probably already fallen off your credit file. A debt becomes statute barred after 6 years since last payment and no written acknowledgement of the debt. On your credit file, you can see what has happened in the last 6 years. If there is nothing showing on your credit file, there is definately nothing going to be added now for this debt unless it was attached to property. If it was a CC, loan or overdraft and had not been secured against a property then it is definately statute barred.

    25%? I'd offer them £20 or £50 as full and final settlement just to get rid of it once and for all - depending on how much it was for.

  • I wouldn't even offer that George, why refund them what they paid for it? They have gambled, and if the poster keeps his/her nerve, lost. Digging up a 10 year old debt, when no one is required to keep records for more than 7, even for the Taxman, is asking for trouble, and if more people tell them where to get off, maybe they will revise their business model and head back to Oslo

    Unless the debt was secured on property or there was a CCJ on it, then it is statute barred.

    The debt still exists but they cannot take you to cort or enforce it. So if you tell them to bog off and to remove all records from their files, they must stop chasing you for it. There is nothing they can legally do that will affect your credit rating, nor can they mark your credit record. As you gather from weegie and 3K&C experience, AK have trouble understanding the situation
    but the law and the OFT are on your side.

    That has not stopped another DCA sending Statuatory Demands but they caved in and apologised when the error of their ways was pointed out. I have no doubt the other DCA will try it on with other debtors, so you need to come back here if anything happens.

    So sedn the Statute barred letter. Do not send them any money at all.

    We refer to your recent request for additional documents/information and write to advise our client AKTIV KAPITAL FIRST INVESTMENT are unable to provide any further details.
    In these circumstances, we have closed our file and returned it to them.
    We can confirm no further action will be taken by Debt Managers Limited in relation to this account.

    Great news :rolleyes: . I await in anticipation for the next set of numptys to try and get money from me when it is not even owed. I hope this has been of some hope to all of you.:rotfl:
