    Hi kitty

    Have a look at the following National Debtline link, and send them the letter that you will find in it, with a Postal Order (NOT cheque) for £1.00.

    They are legally obliged to provide you with this information within 12 working days of receipt of your request, and without it, they can not pursue the debt.

    Send it by recorded delivery, and preface the letter with the words:

    "I do not acknowledge any debt to your company, or to any organisation you claim to represent"

    Do not sign the letter, with your usual signature - instead, print your name.

    If they are able to provide this information, then it will show you if the 'debt' is indeed statute barred or not. See:

    I have never heard of the company you refer to but I have had dealings with Wescot. I currently have an agreement in place with them for a debt that I do acknowledge, but a couple of years ago they wrote to me about £18 I owed a book company which I had paid in full. I had to get copies of cheques from the bank and allsorts to get them off my back. Never heard from them again once I supplied them.

    i'm having the same problem with Wescot over an old Vodafone account which was settled in 2006 by direct debit I dont know why it was ever passed to them but i'm lucky I kept the paperwork to prove it.
    I'm still waiting to hear back from them with a notification in writing that they acknoweldge the account is settled!

    Just an update. Have sent a request for the agreement and account. Will see what happens and will keep you posted. I have received all the letters as discussed before. The latest offering 30% off.

    Interestingly/shamelessly the letters arrive about a week and a half after the date quoted on the letter. Scam to scare you into reacting quickly and/or if it ever gets to court they say that you didnt reply in a timely manner?

    I have had no actual correspondence from Aktiv Kapital, but have had various letters from other debt agencies, claiming that I owe Aktiv £229.91.

    Now, the thing is, when I have phoned these other debt agencies (Debt Managers Ltd., and Call Serve Limited), I have asked them from where the debt originates from, neither of these companies can give me a straight answer, they either say it's from Aktiv, or they do not know.

    I am refusing to pay them a penny, until they will give a straight answer, which, I very much doubt that I will get.

    I have also written to Aktiv, asking for details of this so called debt, but alas, I have had no correspondence from them what so ever!

    Any help on this matter will be much appretiated....

    My advice would be:
    Don't phone them, always write
    Send all correspondence Recorded Delivery
    Keep copies
    Attach Recorded Delivery slips to your file copies
    Print off from Royal Mail website proof of delivery slips & attach to copies
    Never sign anything you send them
    Never give them any proof of your id
    Don't be intimidated by threats of Court Action or Doorstep visits

  • I have just read some of the previous posts about activ kapital. They contacted me a year ago with some old debts (the information they gave me was correct, the amounts and the companies I owed) and I set up a direct debit with them, the debts are due to be paid in full in a couple of months. I'm a little freaked out now that this may not be genuine and that I have wasted all the money I have already paid out (about £2000). How can I go about checking that my money is actually paying off my debt? If it hasn't is there any way to claim it back?
  • I'm pretty much in the same position as katiebeth, had a previous debt which aktiv appeared to take over. Mine was with GE capital for around £2000 @ 29.9% apr, with the balance just over £1000 wen aktiv contacted me. After viewing a recent correspdence I noticed that the balance was still over £1000 despite paying £60 a month 4 well over a year, maybe even 2 years. I've called them and asked for the original credit agreement (woman I spoke to gave a half-hearted "i will try to locate it for you but we don't keep these documents ourselves"), which after reading some of the previous posts is a mistake so i've formalised this request with a letter. I would also like to know if they fail to produce the agreement is it possible to claim back previous payments?

    So, i had a voicmail on my parents phone last night from Gareth saying that "it is in your interest to give me a call before 8pm this evening", and to call 0870 050 1041 and give them a reference number.

    So, I called the (alternative) number and the phone was answered.

    "Do you have a reference number" - so i gave it
    "Are you calling to pay off the amount in full by credit or debit card" - errr... what?!

    So it transpires that apparently i owu ~£80 from a Barclays overdraft, which could have been "a number of years ago".

    I have NEVER received anything from Barclays about this, and I have only been overdrawn once for which i was charged £25 at the time.

    I'm inclined to think this is rubbish, but plan to call Barclays today. If by some bizarre chance it is legit (i genuinely cannot see how it can be...), should i not have received something from Barclays at the time and if i didnt, surely there's some get out here?

    What do you all think?
