You can ignore them if you want, as far as you are concerned you don't owe them money, they have to prove otherwise. If they send someone round then they have no more powers than some bloke walking down the street with a clipboard (you don't have to talk to them and you don't have to let them in)
If they haven't told you what the debt it then they are probably fishing and it isn't actually your debt (if they give you details they are breaching the data protection act).
You can phone them if you like to find out more but you don't need to confirm your identity (they should do this themselves) and don't acknowledge or consider the debt unless you are 100% sure it is yours as they will just carry on hounding you more if they think there is a chink of hope of getting money back.
If you want to you can also send a letter telling them to bog off - the golden rules of dealing with these people are
1)don't sign anything (some people have reported having signatures lifted from things they have sent DCAs - eg cheques (sent when requestiog info from DCAs) or letters)
2)do not acknowledge the debt unless you are 100% positive it is actually yours and that you SHOULD be paying it to them (write at the top 'I do not acknowledge that I owe you anything' to make it crystal clear)
3)send it recorded as otherwise they 'won't' receive it

As I posted earleir in this thread, to those worrying about hefty alleged debts - it really is worth paying for one solicitor's letter. That's all it needs. Once AK know they are dealing with anyone who is even vaguely aware of the laws regarding debt they WILL back off.
This lot really are in the business of harassment and intimidation to collect money, it took around 3 months of phone calls and letters before I ended up with a solicitor, and it all instantly went away. Their advisors are expert at persuasion and jargon (and in my case, downright lies) to get you to start paying them, even trying to wheedle out small tiny payments so they then have something to enforce.0 -
My request was returned (with the fee) saying they are no longer dealing with it and have returned the case to the client. I recieved a letter from Call Serve stating they were acting on behalf of Debt Managers/Active after my initial contact, but on the same day I sent a my CCA request.
I havent received anything for a couple of weeks now so I am not sure whether Debt Managers have called off Call Serve or not. Basically my plan is to not worry about it now and see if anything comes through.
Found this on another site which I thought might be interesting - see reply number 4 for the inside angle on what these guys do for a living. I have decided that these people are scum and legally are on very dodgy ground, some might say fraudulent.

i too have just recently received a letter from debt managers, on behalf of aktiv. never having heard of them and not knowing what the debt was all about i googled them and luckily found this site. i am so glad, because i prob would have called them straightaway and been bullied in to negotiating a payment arrangement. i have just sent off a CCA request with the obligatory PO for £1 and await their response with baited breath!0

I got the same grief from Debt managers so i called the National Debt line and the guy from there talked me through the letters to send them. Got a letter back today saying this.....We refer to your recent request for additional documents/information and write to advise our client AKTIV KAPITAL INVESTMENT are unable to provide any further details.
In these circumstances, we have closed out file and returned it to them.
We can confirm no further action will be taken by debt managers in relation to this account

Just a quick bit of advice please. I too have received a couple of letters from Debt Managers on behalf of Activ Kapital and have no idea what they are referring to!!
The first paragraph of the first letter refers to failure "to make payments under the judgement obtained in connection with the above account" - does this mean that they are referring to a ccj, which I have certainly never had, to my knowledge. Would the CCA letter therefore be appropriate in this case or should I send something else.
Also, I only recently married and the letter is in my married name (albeit spelt incorrectly) and I've not taken on any credit agreements in this name. Do old agreements get updated into married names or would correspondence continue in the previous name? I personally would have thought the latter to be true but may be wrong.

Agreements are not updated. You would have to write to every creditor and advise them of your new name.
The credit reference agencies would record any applications made under your new name separately.
The letter you have received is undoubtedly a try on, so I would send the CCA letter with the £1 postal order.
One final word of advice do not sign anything or respond to requests for proof of id. It is not below these people to scan your signature on to a document and use it as proof of your identity; it is also their legal responsibility to prove that you owe this debt, not your responsibility to prove who you are.

So, i had a voicmail on my parents phone last night from Gareth saying that "it is in your interest to give me a call before 8pm this evening", and to call 0870 050 1041 and give them a reference number.
I received a letter from Debt Managers, on behalf of Aktiv Kapital, demanding £310.44 for an alleged debt.
I didn't reply.
A week or so later I also had a call from Gareth which my OH answered. She told him, in no uncertain terms, that I have no outstanding debts.
A week later, I received another letter offering me a 25% discount. I won't be replying to this one, either.
Interestingly, it included the line: "Settlement of this overdue account may help improve your financial status."
I have checked my credit reports and I have no outstanding debts. As for improving my financial status, I have a very high credit score, according to Experian.
At this stage I do not intend to reply to either of their letters nor any future phone calls. If they send a debt collector round, I will tell him or her where to go. They can try taking me to court, which I think would probably be interesting.
I will post any future developments.
In the meantime, if you know you do not have any outstanding debts, stand firm and don't pay anything. I wouldn't even deal with these people.0 -
Hi all,
I'm hoping you can give me some advice on the above companies.
Firstly, I live abroad - I haven't lived in the UK since I split with my g/f about three years ago.
A few weeks back, my parents at home received a demand (for me) from a company called Buchanan Clark and Wells, on behalf of Aktiv Kapital....
Now, I haven't lived at that address for 16 years! I'm not registered anywhere in the UK and I no longer pay UK tax etc....unfortunately I'ma civilian defence contractor, dividing my time between Afghanistan and Iraq etc - you can appreciate I ahve more important things on,my mind than dealing with this - it's not even easy to deal with it, given the lack of communications/internet where i am usually....
Anyway, apparently their most recent letter states that they have approval from my local court to commence legal action to recover this debt (a relatively low 1200quid).
Now, it's obviously causing my parents some grief - as far as they're concerned, some enforcement officer will be knocking on the door. My question is really - what can they do? I don't acknowledge this debt - I have no idea what it is for and have told them that. They've also been told repeatedly that I don't live there, but my parents still get letters addressed to me and telephone calls...
What's my best move now? - apart from following the earlier advice in this thread and requesting the Credit Agreement from Aktiv...can I just get my mum to send the letters back as undelivered? What about the court? Can a court appointed Bailiff turn up at my parents address, even though I don't live there, and haven't done for years?
Thanks for any help - I'd like to bury this afap!0
