Aktiv Kapital (UK) - Who Are They?

after reading the previous post and also the other thread on credit agreements it does seem that it is enforcable.
Document is entitled Credit Agreement regulated by the Consumer Credit Act 1974. Covers the usual personal details, then a breakdown of credit:
Total Cash Price of Goods and Services (A) 1093.20
Balance Before Charges 1093.20
Payment Protection Plan Premium (B) 163.98
Amount of Credit 1257.18
Add Charges (C) 903.30
Balance Payable 2160.48
By 43 monthly payments of 51.44
Total amount payable (Add A+B+C) 2160.48
Total Cash Price of Goods, Service and PPP: (Add A+B) 1257.18
APR: 29.9%
Then the small print followed by a signature box which has been signed by myself which includes:
"This is a credit agreement regulated by the Consumer Credit Act 1974. Sign it only if you want to be legally bound by its terms."
The original credit was with First National who are part of GE Capital so I doubt there are going to be any 'holes' in their agreements. This document was posted with a statement breakdown which says:
"Thankyou for your recent communication. For your information, please find below a statement of your account from inception to date."
There is then a list of all payments from 07/01/2005 to 21/02/2007, the final two of which say:
"Charge Off PPPRebate" then "Trans. to Solicitors".
Therefore I assume the statement breakdown was sent directly from First National as there is no record of the payments made since to Aktiv Kapital.0 -

I have been receiving letters from the CallServe morons.
Like you - they have my first and surname correct but the address includes a middle name too.... and it isn't the same as my middle name!
There is obviously someone with my first and surname who owes the money ... and my address has been sold on to them by a less than reputable company (which I know as they always have a small mistake in my address and CallServe use it too... I am currently investigating my options under data protection law).
Anyway, I digress.... I have ignored them and I will continue to. What they don't know is that my job requires me to keep all my financial papers for 7 years and routine bankruptcy checks so I am 150% sure that this debt is not mine.
You could download the 'phishing' letter off the nationaldebtline website (don't sign it whatever you do) but why would you want to confirm any details about yourself? I don't want them to know anything about me so I will continue to ignore them. I would advise that other people (who know that the debt definitely isn't theirs) should do too.0 -

I've just this morning received a letter from Debt Managers Ltd claiming that I owe a company called Aktiv Kapital AI almost £2000 _pale_
I've never heard of either of these companies in my life but googling their name has lead me to this thread, thankfully!!!! :A
I've not yet read the entire thread, just the posts since around April this year, but I feel sick to the bottom of my stomach and don't know what to do next
Some of you advocate writing to them and others say completely ignore them, which is what I'm tempted to do to be honest as I'm almost 100% certain I don't owe this money to anyone. My credit files are in perfect order, not even a single missed payment to anyone in over 6 years.
Thing is if I do ignore them are they going to come banging on my door? Don't think my nerves could stand this and I know I'm going to get completely stressed out everytime the post comes or there's a knock at the door from now on _pale_

Then I would write to the DCA, asking for them to prove the debt is yours by asking for a signed copy of the Consumer Credit Agreement.
Remember not to sign anything you send, as these morons are not beneath scanning your signature onto incriminating documents.

I agree with inmypocketnottheirs, I was in the same boat as you when I found this site. I got tremendous help from RAS, Rog2 ,WELLER711, fermi, If it weren't for them I don't know what Iwould have done. Those DCA'S can be quite scarry, but if you follow the advice on the threads all will be fine.:beer:Like good food and drink?

I've bit the bullet and printed off the following letter to send to them following advice in the thread.Dear Sir/Madam
With reference to the above agreement, I would be grateful if you would send me a copy of this credit agreement and a full breakdown of the account including any interest or charges applied.
I understand that under the Consumer Credit Act 1974 [sections 77-79] I am entitled to receive a copy of any credit agreement and a statement of account on request.
I enclose a payment of £1 which represents the fee payable under the Consumer Credit Act 1974.
I understand a copy of any credit agreement along with a statement of account should be supplied within 12 working days.
I understand that under the Consumer Credit Act 1974 creditors are unable to enforce an agreement if they fail to comply with the request for a copy of the agreement and statement of account under these sections of the Act.
I look forward to hearing from you.

The letter is fine, just add the following first paragraph in bold.
I do not acknowledge any debt to your Company. Before I communicate any further in this regard, please prove that the debt is mine by providing me with a signed copy of a consumer credit agreement as well as a full statement of account and a copy of any notice of assignment.
P.S. Do not forget - Don't sign the letter, just use a cursive font or type your name only! They can and will scan your signature on to anything to prove you owe this debt!

i received a letter from Debt Managers about an unknown debt to Aktiv Kapital, and thankfully found this site when trying to get some info on who they are!! This was some weeks ago at the beginning of June I think, my question is what is the full timescale I should legally give them to provide me with proof of the debt? I have some posts which suggest 12 days, but then one or 2 people have suggested they have longer?0

Very briefly, pp - Debt Managers must provide you with a true copy of the original cca (consumer credit agreement) within 12 working days of receipt of your request and statutory fee. If they don't, or can't, do so, then they can no longer enforce the agreement without taking you to court, and are, therefore, in default. If, after a further 30 days they still have not provided you with the agreeent, then they have committed a criminal offence.
There are template letters - you will find links on this thread, which you can send to Debt Managers at the expiry of both the 12 working days (effectively 12+2 days) and after the further month.
Hope that clarifies things for you.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
