Aktiv Kapital (UK) - Who Are They?

    Hi,

    I checked my credit file yesterday as i wanted to see if it had improved since last year when it was awful :o

    I have been accepted for a credit card recently so i assumed it had improved.
    If anything it's worse:eek:

    There are three issues.

    1. There is a default notice there for april last year from Activ Kapital. I currently pay them £20 a month for a small overdraft debt that i will have cleared by june this year. I did not begin dealing with them until Nov last year. Until then i was dealing with HSBC. They also have not updated the amount owed on the overdraft and have not registered any of my payments despite these being by D/D each month. I have never missed a payment.

    2. I had a loan with Welcome Finance and the payement terms were £138 per month over 36 months. There are no defaults registered and the report each month shows that there is no outstanding money owed as aged debt. There are now over 45 payments shown. I no longer have contact with Welcome finance. However the balance shown on the credit report is still the same as it was years ago, ie about £1800.


    3. Finally there are three ccj's on there. One was paid off this month, one is for a loan which i pay each month and will have satisfied in full by the end of the year, but the third one i have no idea about. It is from 2006. I can't find reference to anything on my credit report that would show where it is from and i am dealing with all the debts that i have.

    So my questions are;

    1. Can i get activ kapital to remove the default as it is just not true.

    2. Is there a template of any letter on here i can use to write to welcome and get them sorted out.

    3. How can i get a ccj removed if it is outside the one month limit?

    I have already written to AKTIV KAPITAL that I do not acknowledge any debt to them or any company in their group. I also sent them (AKTIVE KAPITAL) a letter 14 days later as they did not respond to my first letter, so to get this letter was a shock. What is my next move and what do I do.:confused: Any help would be gratefully received, many thanks in advance.

    I assume that they have aatached a paying in slip ? Send the cca of and pay £1.00 into the account. Make this clear on the cca .

    When requesting a copy of the original consumer credit agreement, the £1.00 is a 'statutory maximum charge' which the creditor, or dca, can make for providing the cca. It is not intended to be paid into the account - indeed many dcas will use this as an excuse that you have, in fact, 'acknowledged the debt.
    It should be made absolutely clear on any request, either for a cca, or a SAR, that the enclosed payment is intended purely for the maximum statutory fee for providing that information and not as payment towards the alleged debt.

    BAILIFFCHASER - If your way is quicker than the accepted legal route of requesting the cca, and fully legal, you should post the process openly for both the good of all posters, and for your credibility.

    When you failed to pay the original overdraft with HSBC did they issue a default notice?

    If they did, then is it the same date as the one from aktiv?

    If your loan to welcome fully paid? If so is it marked as settled or satisfied?

    The two genuine CCJ's would normally have to stay. The one that you believe is not yours needs to be queried. Is there a case number or court listed?

    It is straight forward. you send them the cca request. Pay the £1 into their account(you must follow to the letter) Point this out in the cca that the £1 paid on xyz date is for the cca. Wait for the statutory time and if no reply write to the relevant company 5 days b4 the deadline ends to remind them. Then allow a extra 5 days then complain to the magistrates court and enclose a copy of your reciept and also the letters you have sent and ask the magistrates to issue a criminal summons. The magistrates will issue a criminal summons.This will then sort out any problems you may have as nobody wants to go in front of a magistrate and explain why they have no responded or complied. you may find that the other side will make you a offer of compensation and also supply on demand. All you have to do is wait. poeple say for non compliance you have to issue in a county court. the magistrates is quicker.

    Now after having read again these are the points you can raise.

    1. If you are disputing information on your credit file. Write to the cra in question and tell them. Also if you have any letters from a k then send copies of these as well. they will write to ak and query the information.

    2. Re welcome finance : Do you have a letter confirming that the account has been paid off ? If so again send this letter to the cra and dispute the information. They will again go back to welcome finance and query the info. While this happens the cra will remove the info until they recieve a reply.

    3. You can do a search on yourself at : http://www.registry-trust.org.uk/ which will cost you £5 and will list all the registered judgements against you and will give precise details as to where and when. If you have paid a judgement off you will need to get a certificat of satisfaction which will show that the debt has been paid. You will need to pay a fee for this which is here : http://www.hmcourts-service.gov.uk/courtfinder/forms/n441_0406.pdf

    Although the way above is costly. this would be your quickest and most hassle free way of sorting this out. however if you want to go the non paying way then be prepared for writing letters upon letters upon letters.
