  • Hi - NEED HELP!! Last week I received a letter from Aktiv Kapital saying I owe them 137.00 from the thing I purchased from Ernest Jones in 2004. I am quite certain that I already settled the money. I sent them a letter stating I do not recognise it and demanding the proof as this thread has been advised. Today I receive another letter from them telling me that they are now in receipt of a copy of the original agreement but in order for them to investigate further, they ask me to provide them a copy of my identification i.e. driving license or passport and the previous addresses since 2003. I am not sure why they are asking for my driving license or passport and all the previous addresses I have been since 2003. I phoned them and they just said I have to provide them the documents so they can investigate the dispute. Has anyone got asked to send them these documents?? I mean why can't they give you a copy of original agreement? I just think if I owed them money, would someone wanna pretend to be me and pay the debt for me?? Please help.

    No reason at all why you should give them that information. There is no legitimate reason for them to ask for it.

    It's up to them to prove you owe it, not the other way round.:mad:

    When you say you requested an agreement, is this a CCA (Consumer Credit Agreement)? And if so did you send the fee of £1 with the request?

  • Thanks very much for replying. I sent them a letter last week just saying I dont acknoledge the debt and requesting the proof as per the thread but I didn't send a fee of 1 pound with the request. I guess I just did a mistake. What should I do now??

    If they want you to send proof of ID etc, then it sound to me as if they already believe they are on shaky ground with this one.

    Personally, I would just stay quiet for a bit and see if they make any further threats.

    If they do, then immediately send them the letter below with a £1 postal order which represents the statutory fee for the request.

    They are legally obliged to comply with the request.

    Without 100% proof that the debt is due, I wouldn't pay them a bean.:rolleyes:

    I enclose a payment of £1 which represents the fee payable under the Consumer Credit Act 1974.

    We understand a copy of our credit agreement should be supplied within 12 working days.

    We understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

    Hi Guys!

    With regards to the SAR that i'm going to send (haven't been able to get to the post office due to unforseen circumstances) - can I send a postal order for the £10 and do I write - only for sar fee, not for account payment - on the back of that?

    Ideally, you should try to get to the Post Office and send it recorded.

    However, you will be able to see if and when the PO was cashed, and this should be acceptable as proof that they have received the request.

  • I got a letter back from Debt Managers saying....

    "We refer to your recent correspondence and write to advise that we are no longer dealing with this account. Your communication should be forwarded to our client direct. We also return the £1.00 fee paid."

    So what should I do? Sit and wait for Aktiv to contact me? They haven't done so far.Or should I send them a letter?

    Hi rog2,

    Many thanks for your reply - I did just that, went to the PO this fine morning (well, it was better than yesterday!) and posted the letter off with the postal order, recorded delivery. I have kept a copy of everything I have sent so far with the recorded delivery proofs attatched and receipts from the PO.

    Will let all interested know the reply when we get one.
