I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.
I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)
I now require all further correspondence from your company to be made in writing only.
I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.
If you continue to harass me by telephone, you will also be in breach of the Wireless Telegraphy Act (1949) and I will report you to both Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.
Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

Wescot wouldn't know the meaning of the words 'ethical' and 'approachable' if you bought them a dictionary.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

I received a letter this morning from a debt management compnay acting on behalf of Aktiv Kapital. The letter says that I have to respond to the debt management company and not Aktiv Kapital. I have never heard of this company Aktiv Kapital should I still send the letter to them as advised below. Thanks Graham0

I am yet another poor person being harassed by Debt Management on behalf of Aktiv. Got my first threat today!
Ive got the letter ready to send, but just want to clarify that I send it with the £1 postal order to DM not AK as they are the ones writing to me? And do I send anything at all to AK?0 -

We have received a reply from Aktiv - it says..
Recent communications refer.
We writer to advise that your comments have been noted and we are now able to advise as follows.
Upon review of your account the information we hold is that there is a CCJ on the accountand the details are as follows : Case Number ******** - Date of Judgement 31/05/01. In view of this the account is not time barred.
In addition you telephoned us on 6/02/08 and offered monthly repayments on your account. This would be deemed your admission of liability on the account.
We trust that your repayment proposals will now be forwarded to ourselves by return.

I just want to recap that it was I, and not my partner who made the actual payment although it was he who spoke to them when he rang. Also I went to the bank and got them to cancel the card that the payment was made on.
However, does this letter mean we are stuffed? I've never dealt with a CCJ before so i don't know what happens and although it's at his previous address we really need to sort this.
Any advice would as always be greatly appreciated0 -
Because the judgement is over six years old, they would need the courts permission before they could enforce or renew it.
This is not guaranteed, and the court would want a very good reason why the original judgement was not enforced.
Read though this factsheet then perhaps call them up for advice.

If the creditor has been to court and there is a county court judgment outstanding, then you cannot use the Limitation Act to dispute you owe the debt. It does not matter how many years ago the creditor went to court; the county court judgment will still exist. I was just reading about ccj's somewhere else and wanted to add that from what I know OH didn't receive any letters about this to list his outgoings, income etc back then. He would have told me back then as were trying to sort the debts out. I would have definately heard about it from one of the other members of his family as it concerned his mum's address.0
