  • Hi guys,

    Thanks again for the advice. Just got off the phone to the National Debtline - they also advised me to send off their sample letter.

    Also because I and not OH made the payment and it was over the phone it doesn't count toward the 6 year period. They also advised me to contact my bank and instruct them not to allow any payments to be made to Aktiv without my consent.

    Will update on the outcome...

    Sounds like progress. :)

    You may get a letter back from Activ waffling about "moral obligations" regarding the debt, and that they will refer it to their legal department to consider further action.

    But basically, if they send that it means that they know they don't have a legal leg to stand on, and are hoping that a few last vague threats will make you pay something when you don't have to.

  • I received a letter from Aktiv Kapital stating that i owed them over 300 pounds. Not thinking i assumed that i did owe this money and set up a direct debit of 50 pounds a month to come out each month to pay it off.
    I already started with the first payment but I missed the second payment and got a call from them to receive the money, so i paid it over the phone, setting up a direct debit. My wife showed me this forum so i canceled the direct debit in January this year and I haven't received a letter or got a phone call from them. Only downside is....they have 100 pounds of my money....my loss.
    Don't know really whether or not to chance my luck and ask for it back. My own fault really for not thinking. Thought I'd let you all know anyway.

    You can query the direct debit with your bank by saying that when you looked through your statements you noticed that a direct debit has left your account for 350 and you do not know who or where this has gone to. when they tell you deny it. they will then log a dispute and send you out a form. fill it in and you will have your cash back. Same with the cc. Dispute the transaction.

  • excuse my ignorance,if AK dont have a copy of the original leaflet/flyer thing I signed 7 years ago(I have paid toward it so cant statutory barr) for my overdraft their chasing the cannot chase the debt?

    Sorry for being thick,had so much jargon from them,and thanks for any reply
