    Steve - if those guys show up just set the missus on them.

    Have a read of this thread - by law the debt is unenforcable and once you state that payment will not be made, it can no longer be persued.

    In that very unlikely scenario, you just ask them to leave immediately, as required under the OFT Debt Collection Guidelines, to which they should adhere;

    If they failed to leave immediately, call the Police.

    And let them drink their own tea.

    I realise it's quite hard when you feel you're being hounded by these people, but if the debt is statute barred you really do owe nothing.

    Make sure you send the statute barred letter from one of the links above by recorded delivery and print rather than sign your name. If they are still harrassing you, complain to the Financial Ombudsman and Trading Standards.

    Try not to let this get you down. Once they realise you know your rights it won't be worth their while bothering you. You just need to make it clear to them that you know that they are full of it and can cause moreproblems for them than they could ever cause you.

    I have sent two letters to this Company requesting the CCA I have had a letter back after I sent my second request recorded delivery, saying they had applied for the CCA, that was before Christmas and all I have had from them is a letter threatening to pass my account to their solicitor. So now its stalemate... until they send the CCA I have no intention of responding to them.
    BOI Credit Card = Was £3500.00 Now £0.00
    GE Capital Store Card= Was £1800.00 Now £0.00
    GE Capital Store Card = Was 1300.00 Now £0.00
    Credit Union Savings Now £200.00 :T

    Oh I had this... send them a letter "Acknowledging No debt" asking for the CCA and informing them that if anyone calls to your door you will contact the Police immediately and report them for harrassment.... I got an apology...but no CCA *sigh*.... the wait goes on....

    What date did you actually request the cca? They had, legally, 12 working days (allow 12+2) from receipt of your request, in order to send you the cca, without which the agreement is unenforceable. It matters not whether they have 'applied' for the cca - they have an obligation to provide this whether they are the original creditor or not.
    Looking at today's date, the 'debt' is no longer enforceable without a Court Order and, very soon, AK will be guilty of committing a Criminal Offence.

    Their reply letter stating they have "applied for the CCA was January 10th I sent my letter to them January 7th.

    Does anyone have a standard template for reporting a Company to Trading Standards?
