Aktiv Kapital (UK) - Who Are They?

    Hi Guys,
    Am very new to this site and until I googled Aktiv Kapital thought I was the only one they were hassling.

    I have recieved regular phonecalls to the tune of 2-3 per week for the last 12 months from these people about a debt with tricity finance from about 13 years ago, when i have told them that i know nothing about the debt and in fact the addresses they have for me I never lived at they reply that a payment was made on the account back in '96 so it must be mine, they also keep promising to send out info to prove the debt is mine that never arrives.
    Now I have found this place I will try using the letter that has been posted to see if this helps to sort the problem and will report back what the outcome is.

    This 'alleged debt' is almost certainly statute barred, os. Have a look at the following link, and send them the template letter that you will find, there:

    Have read few of the posts here regarding Activ Kapital, and understand they are to do with Westcot?

    I have a payment arangement with wescot as a debt that was owed to powergen, this is a mere amount of £110 and so will be cleared in 3months.
    I now have this Activ Kapital texting me and calling me, do you think they could be to do with the same debt?? They only got in contact since ive had dealings with Westcot.
    They dont write to me because they dont know my address so shall i just ignore the calls and hope they fade away when debt is cleared or shall i ask what they are after??

    Yes - ignore their calls. They should not be pursuing you if you have already reached an agreement with Westcott.
    If AK are legitimately trying to pursue you on a separate matter, then they should, easily, be able to find your address and, if the matter is that important they will write to you.

  • Im not sure what to do next. The story so far ..

    In late October 2007 I recieved a letter from aktiv kapitol / Debt managers saying that I owed them £300 . I wrote back 7th November enclosing £1 and the letter asking for a signed copy of the CCA and a statement of account . ( at this point I was not sure how recent the debt was or even what it was for )

    I have now recieved a reply back enclosing the signed copy of the CCA ( yes thats a first, just my luck) but they did not sent me a statement of account . It relates to a storecard opened in 1998 - almost 10 years ago. I know for sure that I have not made a payment on that debt for at least 6 years.

    So now it seems I have a few options.
    1. Write to them stating that they have not complied within the time limits to send the CCA AND statement of account and that they are commiting a criminall offence, will be reported to trading standarts and OFT if they write again .
    2. Send the statued barred letter.
    3. Just ignore them, Im still waiting for my statement of account as far as I am concerned.
    4 Write a letter combining points 1 and 2 .

    Thanks in advance for any suggestions.

    in comment to a post further up the page do CCA's appear on your credit report? Halifax Cetelem transfered my debt to Lewell but I don't have them on my report.

    If I were you I would assume that they have not sent the statement of account as they know that the debt is stature barred and they are simply trying it on! I would write them the statute barred letter. If they believe the debt is collectable they will have to prove to the court the debt is within the six years.

    The worst comes to the worst and you have to pay something, then I would be thinking of an offer around £100 full and final. But I would not make that known for a long while yet.

    Only if the CCA's record them with the CRA's. For example (W)1st Credit do record them.

  • They are a company based in chester that but really old debt. Not had any experiences with them myself but i hear if you stick to your guns with them they will accept whatever payment you can make.
