Aktiv Kapital (UK) - Who Are They?

  • i have had a letter from AKTIV KAPIATL saying that i have a debt of 400 pounds going back to 1994 .I not not know anything of this debt but it is from my old address . I have spoken to AKTIV KAPITAL and said i will pay 200 pound even thou i am not aware of this debt.Now that i have found this web site i do not know what to do ........any suggestions.

    Hi everybody...I'm a new poter on this forum. I have also been having a running battle with AKTIV KAPITAL. Here is the story so far..

    Had a catalogue with a member of the JD Williams group, which the balance was paid and they were told that i no longer want the credit facility. A few months later i received a NOTICE OF ASSIGNMENT from JD saying that the debt of £0.00 will be assigned (Giving a list of companies which AK are one). Spoke to JD and told them that the account has been paid and closed. They said that the letter was a mistake and to ignore it. About a month after that i started getting letters from AK regarding a debt of over £200 in relation to JD (ODD). Sent AK a CCA request and got a lovely letter back that basicly said that as they are not the original creditor they do not have to obide by the CCA. Apparently they only purchase the debt and the right to collect it and not the rights and resposibilities. Now having checked my credit file i find a nice big default for a Store/Credit card, not a catalogue account. So heres my problem, they have processed data to a third party that is innacurate, they are trying to get over £200 out of me for a debt that has been paid. The unfortunate thing in all of this is that i didn't keep the recepts for paying the account. The only thing that i do have is the notice of assignment showng that the balance transferred is £0.00.

    Thats my story, any opinions on where i should go from here??

    Lal From what I understand once statute barred (over 6 years) always statute barred. Even if you admit the debt or promise to pay they still can't make you. Write to them using the letter about statute barred debts given earlier in this forum and send it recorded delivery. Keep a hard copy and then forget about it. They will come back and offer you discounts and threaten doorstep collectors. Just ignor it all, the law is on your side.

    Oh yes they do! If they cannot produce a copy of the original signed credit agreement then they dont have a leg to stand on. Use the letter asking for a copy of the original signed credit agreement stated in a post on page one of this forum thread. Send a £1 postal order and photocopy it and the letter. Then send it recorded delivery and keep the postal receipt. They have 30 days to produce the documents, if they cant then they have to accept that they have no claim.

    They won't and will keep going with letter after letter but it is all meaningless.
    The only thing that i do have is the notice of assignment showng that the balance transferred is £0.00.

    You could try enclosing a copy of the assignment with its zero balance, but I wouldn't bother. Its up to them to prove you owe them the money.

    Hi I have a debt with Aktiv Kapital who bought it from Wescot.I admit to owing the money though as it was a deabt I knew I had.I have a balance of £1500.They wanted payments of £50 per month which I wrote with a soa and said I couldn't pay.I offered £2.83 which they replied asking if I could increase.I replied no and they accepted my minimal payment.Once this was set up then I have had no problem.My payment goes out by standing order and I have receive no more correspondance.
    I appreciate some of you dispute your debts and are therefore right to ask for confirmation.But If you do find that you do owe the money then you should find this fir ok to deal with.My experience anyway :)

    I have put the CCA request to them and all i get back is "We are not thje original creditor so we don't have to supply it. But as a matter of good practice we have requested the documents from the OC"...Now they are threatening Legal action....BRING IT ON

    Hi Molly

    In my husband's case he doesn't remember ever having the debt they are chasing. He certainly hasn't taken out any credit with them since Ive known him and thats 14 years.

    Please bear in mind it is very unlikey Wescot would pass on a debt they could collect themselves. They may have originally been asked to collect it but when they couldn't find you or didn't process it in time, they would have sold it on to Aktiv to cover their costs. I am assuming your debt is more than 6 years old, please forgive me if it isn't. (If it isnt and you owe it then paying it in installments as you are, is only fair.) However if it is more than 6 years old the company you originally owed it to would have claimed on insurance or written it off against tax. Either way they will not be receiving any of the money Aktiv are collecting. Only Aktiv will make a profit from your payments.

    It may make you feel better to pay a statute barred debt but if you bear in mind your original creditor has already been compensated and you are paying the "vultures",it kind of puts a different slant on it.

    As I said in your case it may be a recent debt and if thats the case you are right to pay it. I wouldn't want to encourage anyone to shirk their responsibilities.

    Here is my story, i tried opening an online bank account, First direct, from over here in Germany, (British Soldier) due to me not having an english address they asked for a family member who would be for correspondence only, so i gave them my sister in laws home address as we are in contact.
    The bank account application never succeeded and that was the end of it.
    A few weeks later, Aktiv Kapital started sending letters claiming i owed £444, but they were sending them to my sister in laws address, obviously i have never lived there, she has explained to them that i have never lived there and that she has passed on thier telephone number to me, of which i have tried to ring but with no avail as some numbers i can not ring from my german phone line.
    I would just like to know how they got my sister in laws address with my name, surely First Direct didn't share my correspondence address with third parties?
    Any help on what to do would be great.:confused:

    They have 'traced' you to your sister in law's address because it would have shown up on the Credit Reference Agency as a result of the Credit Search that 'First Direct' would have made when you applied for the bank account. These scum (AK) continually 'trawl' the credit reference agencies in their hunt for new victims.
    Your Sister in Law is under no obligation to provide any of your details to AK and AK should not harrass her to do so. If they do, ask your SIL to report them to the Trading Standards Office.

    Just don't understand how and why First direct would register that address with the credit agencies when they knew i didn't live there and it was for correspondence only...strange.?
