Aktiv Kapital (UK) - Who Are They?

Hi everyone
I posted on this thread on 12th July regarding those wonderful people at Aktiv Kapital and I said I would let people know what has happened since.
Rather than paste my rather long post here, I will do a quick recap:
I received a phone call out of the blue from Aktiv Kapital regarding a debt they stated that I owed from 1997, which I could hardly remember.
They stated they would send me out giro slips to make payment - very generously (ha!) said they would make the repayments less than what they originally were requesting me to make and my first payment was due on 1st August, blah blah.
I found this wonderful thread because I was sure they couldn't hound me for it after so long and to my delight, copied the letter about the debt being statute barred and sent it to them recorded delivery.
Since then, until recently I have received at least 3-4 phone calls from them per day (No exaggeration!) The earliest time of day was 7:55am and up until around 8pm. I very soon recognised the number, so refused to answer the phone!
One day, I had had quite enough and answered the call. The person on the phone asked to speak to me and asked me for my date of birth etc - I stopped them and stated I was not prepared to divulge any personal information over the phone and asked who they were (even though I knew they were Aktiv) Before she could say anything else, I stated that I had written to them recorded delivery in July stating that the alleged debt was statute barred: I did not acknowledge any debt to them: I had not received any reply to my letter and told her that if they wish to correspond with me at all, they must put it in writing, and anything received would be passed straight to my solicitor. I made it clear I would not speak to them on the telephone any further and if I received any more calls I will be seeking legal advice on whether it could be considered as harrassment.
That was about 10 days ago and since then, I have not received any more calls! (unless they phone when I am in work!?!)
I am really hoping this is the last of it, but will wait and see if anything comes through the letterbox, or maybe 2 burly men turn up with baseball bats!
To anyone who feels they are being bullied and intimidated by these companies out there - stay strong.

And well done to you, tishyscash, for standing up to these bullies. :T :TI am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

My Husband received a letter almost a year ago off these people and he sent the letter suggested in the earlier posts asking for a copy of the original signed credit agreement. I sent it recorded and included a postal order for £1. They never replied. Today I received a letter saying a doorstep agent would be calling so after reading through the posts here and not wanting to waste money on paper and stamps my husband sent the following email.

I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter.
1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number ………………
2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.
3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not.
Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.
As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.
Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.
The Statement above was sent to you by post back in 2006. It was sent recorded delivery along with a £1 postal order. I still have the postal receipt and a copy of the original letter photocopied with the postal order.
You failed to comply with that letter and have therefore committed a criminal offence under s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit)
The letter you sent me dated 15th October 2007 is also in breach of the act as you offer me no proof that you actually own the debt, if indeed it ever existed. I have no memory of ever having any credit with First National Tricity Finance.
Sending someone to my home for the collection of a debt that you have not been able to prove is also a criminal offence under the act and if such a person should turn up at my house claiming to be collecting on your behalf the police will be called.
As you have failed to provide the requested documentation in the time allowed by law any alleged debt is now void. If you wish to pursue this matter or if I receive any further demands for payment I will take legal action of my own.
I will be expecting a letter from you in the next 14 days to tell me that this matter is now closed.

What an opportunity!! For the right candidate:rotfl:
have to hurry deadline for applications is 30/10/07
Perhaps someone from rouge traders could apply or an insider from watchdog just to see if they are trained in these underhand tactics.0 -

Ugh..I think that job advertisement is disgusting. They know very well that these alleged debts are statute barred and still think "persuading" someone to pay them is even remotely acceptable. These vile pieces of scum should be run out of town and banned from ever operating again.0

Well done, but how did you let them get so far. I have let several people speak for me, and can assure you they have not confirmed name before being sidetracked into divulging data. I can say that Data Protection and Activ are 2 separate things0 -

Basic, no wonder why you get stuck so often with such minimum requirements. Oh dear, wonder why they would not employ the likes of us!
An understanding of the Data Protection Act, CSA Code of Practice and OFT Guidelines is also advantageous
We know the Consumer Credit Act that covers the very agreements you talk about. That makes us 100% better than any who know the above.
Must be competent in documenting conversations that have taken place on the phones.
So you do not record calls then, unfortunately for you, we do.

Not the best solution for their "customers" (for customers read victims) then!
The really sad thing is their website has a section called "our Vision and Values" The sad deluded sods actually believe they have values!!

To tailor our vast experience and knowledge to each individual set of circumstances....... Does anyone feel special! every letter we have had has been the same as every one received by people on here. More of an "off the peg" operation in my book!

I think they want someone from the dark realm for that negotiator job. Why else choose the day before haloween as a closing date.0
