    Unless they tell you, at the beginning of the call, that the call is being recorded, then it would not be admissable as evidence in court.

    It would appear to be quite common for dcas to say that 'there was a small payment'. This appears to be an almost standard ploy to 'keep the debt active'. Never mind - it is up to THEM to prove this.

    Shouldn't they send all the details of the debt, they manage to tell you how much the debt is for, but they don't send any proof that you have an outstanding debt. I think that they should be made to send every bit of evidence concerning the debt that you supposedly owe, instead of having to dip into your own pocket to prove your innocence. It really makes me angry:mad:
  • Hi I'm so glad I found this thread, you guys are genius' its been so helpful to read all the posts.
    Id never heard of Aktiv Kapital but they're on my recent credit file. Should I send 'the letter' to them as I have not recieved anything from them. The debt is apparently from 2005 but I don't know how or what its from. I'm worried about the amount of harassment that people have experienced but I want to clean up my credit file.
  • Personally I would wait until they contacted me, why do their job for them?

    Time Retail Finance is the 'timecard' which Comet often mis-sell by offering to "send you an invoice". I think the APR is 29.9% and the sales staff must get some huge commission for every timecard account they open given their underhand tactics to get you to take one.

    Have Comet been taken to task over this?

    I too have recieved letters from Aktive Kapital stating I owe them £3300 on behalf of another company, although I didn't acknowledge the debt, I agreed to pay them £40 per month. The debt in question is 6yrs old and there is doubt in my mind as to the figure they are asking for. I live in Scotland and the 5 yr statuate barred comes to mind. Even though I have paid them £50 to date and I have since discovered through this site, may not be entitled to this money, do I need to continue payimg them?

  • No, once statute barred, always statute barred - any later payment cannot restart the clock but they will probably try to tell you otherwise.

  • I received a final demand letter today from the above named people, I have never heard of them before. The debt is 262.08 and I think it is for a store card that I didn't receive from John Lewis. I have never had a bill and this is the first correspondence I have had regarding the debt. Debt Managers LTD are acting on behalf of Activ Kapital. This debt is apporximately 6-7 years old and I think that it is a disgrace after going in to Lewis' to try to pay the outstanding amount and being told to wait for a bill/card which I never received. What can I do? Should I send a letter stating that the debt is not being acknowledged?
