Thanks rog2 for your advice. On reading previous posts on this thread, it is amazing how many people have had similar dealings with this company in one way or another.
It is quite scary what goes on out there!

Legal & Trade are another debt collecting agency who would have bought the debt off Argos previously. Aktiv Kapital did not buy the debt off Legal & Trade, surprising as it may seem they bought it from Argos, probably within the last year or so. In both cases I have quoted Argos for simplicity, in reality it will be the finance company that Argos use for their credit agreements.
Rog2 is correct, I will just expand a little further. Once a debt is statute barred then it is ALWAYS statute barred, you cannot restart the clock by making a payment or written acknowledgement of the debt again. A debt becomes statute barred 6 years after the last payment/acknowledegement, 5 years if you are lucky enough to have signed under Scottish Law.
The Limitation Act which is the legal document relating to statute barring does include a clause that allows the court to extend the limit in extreme circumstances. What Aktiv Kapital are trying to do is make you believe it is entirely your fault they could not trace you and they have a case to extend the limit. I think you have already worked out that they have not tried very hard to find you at all and as they know they do not actually have a case. Assuming you owned your previous property they will have bought a copy of the deeds, anyone can for the grand sum of £2. From that they have identified your partner too so it is very easy to find your number in the phone book. It is possible that they still assume you live at your previous address and have sent a few letters there recently and are now phoning because they have had no response, it does depend how often they actually bother to check even the basic of information. Another way of you leaving a trace is the credit reference agencies, each time you make a purchase within the first 3 years of moving, including any current mortgage, there will be a link to your old address, after that of course the link to your old address will be permanently on your credit file anyway. Then of course there is the electoral register, guess what, this is updated with address changes EVERY month of EVERY year. Now it is much clearer how little effort they really put into tracing people and keeping up to date.0 -

We bought the house some years ago and are still receiving threatening letters address to the previous owners. It doesn't matter how many times we write to tell them they no longer own the house they still persist in sending the letters.

You could try writing to them (recorded delivery) restating that you have informed them, on numerous occasions, that the person they are looking for no longer lives at your address, and demanding that they remove your details from their database.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

I have no idea what it is for and have been married for four years.

Since my last post I have received payment slips from Aktiv to make payments. Funnily enough I received them the day after I sent my letter recorded delivery to them (informing them that the debt is statute barred - I don't even remember what it was for!) They requested that I made payment on 1st August, but I have not done anything at all and I am waiting to see what happens next.

I recieved a letter from CALL SERVE yesterday saying I had recieved goods or services that I hadnt paid for and they were working on behalf of Aktiv Kapital, they said I owed them 844.00.
So after reading this thread I called them.......the woman got very shirty with me and said I owed the money from a Debenhams account from 1998!!!! I could tell from the echo on the line that I was being recorded so I said to her "are you recording my call because I am recording yours" she said " we can record your call because it says so on the bottom of the letter", I replied that the only thing on the bottom of letter was do not write below this line!! She then said " Oh well Im not happy that your taping me" she then terminated the call after asking me to put in writing that I did not acknoledge the debt/ 6 year etc.....
I sent my letter recorded delivery yesterday afternoon.........
I will let you know how it goes.
PS she did keep trying to say that Debenhams had been trying to contact me and that I had made a small payment 3 years ago.....I asked for proof of this as I know this is untrue.......so lets wait and see what reply I get.:rolleyes:0
