Aktiv Kapital (UK) - Who Are They?

  • Hello people! I'm not sure as to where I should be posting this so I hope I'm not stepping on anyones toes by asking a question here. In 2006 my wife passed away. Three days ago I received a letter from Active Kapital (UK) regarding an alleged debt between my late wife and Lombard Tricity. The amount involved is £367.00. I personally have no knowledge of the debt being taken out so my question is; am i responsible for this debt? I did call them to explain the fact that my wife had expired but they would not listen and the person to whom I spoke was, to say the least, very ignorant. For this to come completely out of the blue has really been a very big shock to my system. Any help/advice would indeed be a guiding light.

    I would very much doubt that you would be responsible for your late wife's debt perse, but you may need to get clarification from the solicitor who dealt with her estate. Whatever the case it is in extremely bad taste for AK to pursue you for the 'debt'.
    AK are legally obliged to give you full details of the debt that they are pursuing, along with an up to date statement. I would, also, request a copy of the original signed cca, if it was a 'hire-purchase' debt. If AK are unable to provide this, then they can not legally enforce the agreement.
    If they do provide this, at least you will be able to check the T&C to see if you have any legal responsibility for the 'alleged debt'.
    I think that a call to CAB or National Debtline, who can give free, professional and impartial advice, may clarify your responsibilities.

    as for the debt, i'm sure someone will be along shortly to help you.

    i know that when my mum passed away my dad did not have to pay for a loan that was in my mums name but that was about 17 years ago.
    happy to be debt free (apart from mortgage: £111,000 @ sept 15)
  • i to had 2 letters demaning money which i did not reply and today i had a letter saying

    you have failed to respond to our previous communications therfore our doorstep agents have now been instructed to call at your address to collect
    the full amount owed

    you have a final opportunity to prevent this happening by simply calling the above number you may be entitled of up to 30% (without prejudice} for a immediate settlement they have changed from aktiv kapital barclays to active kapital asset investment any help guys

    We need a bit more info , how old is the debt, when did you last make payment, what is the debt for ?

    Do you owe this money , and ( not trying to be funny but ) have you read the whole of this thread?

  • hi back i 1999 i had a unsecured loan for 1000 with barclays bank last payment was made back in 1999 and at the time i was ill and on benifits
    i went to see the welfare rights officer and he wrote letter and it was wriiten off so i was led to belive. as far i was told it was wriiten of by barclays i had paid quite alot back to them the bank manager was a right pain excuse my english

    If you are sure the last payment was made in 1999 the debt is probably statute barred ( over 6 years old). These links should help

    There is also the statute barred letter further back in this thread. I would send them that.

  • what happens then if 2 big guys in a white van arrive and start knocking on my door for payment then,should i give them a cup of tea and say o buy the way the money is statue barred
