I think the powers that be should decide what constitutes a contract to buy. Receiving an email is like shaking hands, even more so if you pay your cash, then in my opinion that is the contract.
OK this is a miss price error, the B&Q error was technical, supposedly, but when does a deal become binding.
I don't agree with people ordering lots, by the way.

No I certainly didn't expect a TV for 49p but like many of you I chanced my arm! However I do think it is time that the Law is clarified with regard to Internet shopping. That said I don't think this Argos misprice is the best vehicle for a Class Action. The ebuyer TV I think would have been a better example after all they didn't even adhere to their own T & Cs and they did advertise as being an unbelieveable price!0

I didn't go for it only because I missed Argos and realised Sainsbury's would have same result, it was a clear misprice and as legislation allows for such I would certainly not have pursued it had I put an order in, merely because the I know the time and effort expended would have been wasted, most people that recognise my id on here will agree I am not averse to spitting my dummy out and throwing the toys to the floor all in one at the drop of a hat, that having been said there is absolutely no point in chasing a train on a bicycle and expecting to win the race! move on whilst you are expending time on this you could be searching for a really grabbable bargain, you have already missed out on the boots points profit as all the best returning products are now sold out and that is one that is guaranteed a pay out, check out the Boots Grabbit thread and put your time to better use, yes you are p**ssed off but get used to it, you can't win them all,Four guns yet only one trigger prepare for a volley.Together we can make a difference.0

I'm normally somone who just reads the posts here, and very rarely do I add my own...but I just wanted to have one say, and it it is something that has already been said a number of times on this particular post.
We are all here for one reason,, to get a good deal, wether it be some crappy little freebie, or £10 off something we or someone else would really want...and yes every now and then, something cheaper than it could possibly ever be (I for one was able to pick up a Indiana Jones, Monty Python and Charlie Chaplin box set on Amazon last week).
BUT...and it is a big but....although we all wait for the special one off deals (lets be honest...they are always errors) do we all really expect to get the deal done start to finish...the answer is NO...I don't think we do. We are all hoping that we might be one of the buyers thats gets what we ordered...but more than likely, we are to be one of the guys who are a bit gutted that we didnt.
But I don't think for one moment we should be thinking of starting to take a class action out on a company that made an honest mistake, and actually it is more likely to have been one poor employee who is now unemployed, Yeah it would be nice to get the money back staright away, but if we were more than happy to get a good chunk of money for nothing, then we shouldnt be shocked when it takes the company a while to get a refund to you.
And to the ebayers out there......lets be honest, the reason most of these deals go wrong, is becuase these guys want to take the wholse sotkc for themselves....and normally these are the guys that are moaning becuase they feel they have been cheated.....POT KETTLE I feel.
So there you go...I'll stand back and await the flamesTreat everyday as your last one on earth! and one day you will be right.0 -
