I made a mistake but the buyer is being difficult help

    it would be easy enough to find out wether or not they actually said this. we can all see their ebay user name, so someone could alert them to this thread and let them defend themselves.

    Can somebody please do this. I'm off to make some popcorn* as this could be interesting.

    Although i feel you were in the wrong to start with, you have now been subjected to bullying by the buyer. She will get all she deserves (not for wanting a refund but her bullying) by Ebay insisting she sends back at her expense.

    In reflection seller could have handled better at an earlier stage but to excuse the seller of making things up without a jot of REAL proof ( only amateur hand writing experts) is a little unfair.

  • First of all thank you to the many people that have informed us of this discussion we are very grateful - this issue is in the process of an ebay dispute and that is where it should have stayed but from the many responses we have read here it would seem that you all feel the same as us - why should we be out of pocket because of a sellers mis-listing. We were under the impression that there were two dresses which were sold as BNWT (Brand New with Tags) - we only received the one and this had no tags attached so we had to take the sellers word that it was brand new. We contacted Miss-Piggin who offered us a refund if we sent the dress back as she admitted it was her mistake - then when we emailed her to say this is what were were going to do she changed her mind and only offered a partial refund but before she got our email saying that we would return it she had already filed a withdrawal claim with ebay to get her fees back - this should have been done once the dress was back in her position - we refused it saying that at this present time we had not reached agreement but we also told ebay that we would have no objection to completing one for her once the issue was resolved. We accepted that she had already paid out postage costs but requested that she pay the return postage because it was only being returned due to her false description. This she refused, we gave her many chances to resolve this issue as we did not wish to bring a dispute with ebay but she left us no choice with her attitude. It seems to us that she wants the dress back, with us paying a recorded delivery postage charge (she has requested this), her listing fees back and all she wants to refund us is 4.70 - this does not seem fair. Perhaps this clears the issue up a bit as you have now heard both sides of the problem - we are willing to let the ebay process deal with this issue and so should Miss Piggins - by the way we paid by cheque as she does not have paypal although she has offered to send the refund by this method.

    Really good to hear two sides of the story for a change. Perhaps I was a little presumptious in my previous reply. Just out of interest what made you decide to reply now and how did you hear the dispute was being aired on his site?

    that was a bit of a damp squib. I was thinking we would get some heated argument with hair pulling and scratching.

    Can we have a happy ending now instead? - Miss Piggin says "I'm sorry here have your £6 odd back and keep the dress"
    Samandruth say"We're sorry too, thank you for our money back I'm glad that this is over"
    Miss Piggin "I've learnt a valueable lesson ..."
    Samandruth "us too, we should have communicated more at the start this is all our fault"

    Wise words RabbitMad although from our point of view Miss Piggy was rather flexible with the truth if Samandruth is to be believed. Oh its better than Corrie. No salted popcorn then RabbitMad?

    This is the key part, we have now heard both sides and one or the other or both is not being entirely accurate in their version of events. We are not in a position to judge either party, it just needs to be left to the dispute process and both parties to do what they feel is right.

    I didn't like the way this thread was heading, and I think it's pretty underhand to involve the other party, to be honest. This isn't bloody Q&A, this is meant to be a friendly site and the OP has been accused of fabricating emails. Not on, imo.

    Here's how I see it

    OP should have been a bit ready to refund, and a bit slower to open the mutual dispute
    Buyer has now rejected the mutual, which means OP will never get their fees back, unless the buyer pays them.

    A decent seller will not pay any refund until the item is returned. Regardless of the amount offered, that's the way it's got to be - so OP wouldn't be wise to send you a refund in advance, and they're not obliged to do so unless they're feeling reckless or generous.

    OP ought to refund in full (once item is sent back). I'm sure the buyer has realised by now that ebay will not force them to do so... hence the slightly barking suggestion of suing the OP.

    For goodness's sake...

    OP, agree to refund in full including return costs. You'll have to work something out about the fees you can't get back.
    Buyer, accept offer, and post item back. Trackable if you're sensible.
    OP refund when you receive item

    Get on with your lives...

    i,m at a loss as to why people felt the need to email the buyer here
    its a minor ebay dispute over a small amount of money and a relativly minor mistake
    given a full refund and keeping the goods was offered(in the end) i dont see what the issue was from that point
