I cant believe this still hasnt been resolved !!

Its a simple case of a listing error, not the end of the world, putting yourself in the shoes of the buyer so far they have,

Paid for 2 new tagged dresses and received 1 (possibly) used one, then they were told 'well yes it was my mistake but if you want me to rectify it you will need to be out of pocket by even more money' ????

Even if the seller was trying to make the best of a bad situation by offering a 50% refund, the buyer wasnt obliged to accept it, and really the only person who should lose out financially is the OP,

I think the seller has made enough of a mess of this and this buyer should really just be sent ALL their money back with an apology for making a slight hick-up into a total balls-up.

They received one brand new one, so I offered her half of the money back £3.35 which I thought was fair.

I don't see why I should loose out on even more money the dress cost £20 in the first place, it sold for just £2.70 I paid £4 to post it to the buyer and have paid ebay fees, now I have to find £6.70 to give her back she gets to keep a brand new dress and I loose the money from the sale, my ebay fees and the postage costs to send it out, I am trying to be fair if she had accepted my original offer she would have a brand new dress and a £3.35 refund she would not be out of pocket

.. but to excuse the seller of making things up without a jot of REAL proof ( only amateur hand writing experts) is a little unfair.

Just a small point - I did not accuse anyone of making anything up. I offered an opinion (actually based on 30 years in law enforcement) that two of the emails quoted were not written by the same person, an opinion I stand by, and which I would suggest has been reinforced by the coherent posting from 'samandruth' we've all seen here. The words mountain and molehill spring to mind.
If in doubt - do something. (With fond memories of Harry Chapin)

Probably because you still havent refunded her and are on here looking for a way to get out of your mistake, i imagine she has checked out your feedback and doesnt trust your word anymore hence the dispute and threats of court action.

If you are in agreement that she deserves the refund stop stalling and end this saga for both of you,

This why the buyer has lost patience and opened the dispute.

Which part of “it’s your fault, do the right thing and send the woman her money back” don’t you understand?

Really good to hear two sides of the story for a change. Perhaps I was a little presumptious in my previous reply. Just out of interest what made you decide to reply now and how did you hear the dispute was being aired on his site?
because somebody on here bothered to look for the user name on ebay
then saw if they could contact them through ebay
then told them about this thread
then sat back to watch fireworks
which is really quite sad if you ask me
and i know you didnt but im just saying anyway:p
I am not bossy I just have better ideas:p
  • I have offered her her money back, and she opened a dispute she doesn't seem satisfied with a refund, I have asked her countless times how she would like refunding ie through paypal or by being sent a cheque but with no reply

Maybe one of the emails was typed for the OP by a family member?
My Hub often replies to ebay emails for me and vice verser, and he has different ways of putting things etc.
    Just a thought.
