I made a mistake but the buyer is being difficult help

    hi she is threathning to take me to small claims court can she do this?

    i really don't think that someone would pay £30 or whatever it is to file a claim over £6.70 that you have offered to refund her in full and let her keep the dress.

    just let paypal deal with it now

    Its most unlikely she will pay out of her pocket to do that it is simply what you say 'threats', let ebay deal with the dispute, keep all the emails she has sent you and if you get any nasty messages outside the dispute forward them to ebay.

    Yep, and she would win and get all her costs back including the £40ish court fee, travelling expenses etc.

    However she would be mad to do so as the hassle and time involved for such a small sum makes it silly. (As silly you not just refunding her in full in the beginning.)

    On the other hand she might regard it as a point of principle after being messed about so much that she’d be happy to spend the time to get what she is entitled to and cost you hassle and money into the bargain.
  • Yes, that's what I told her or I offered a 50% refund if she wanted to keep the one dress, but now she's getting nasty just had this message from her:

    Now your the one at fault in faulsly describing the item so any loss you fall upon you and not me this is your FINAL CHANCE to resove this issue by giving me a FULL refund including the return postage if I get an offer of a full frfund within 24 hours I shal have no alternative but to file a dispute with ebay and LEAVE NEG' FEEDBACK witch i dont like doing so the ball is now in your court

    Interesting....IMHO there is no way that the same person who wrote this, from your earlier posts

    I've been following this thread with interest. And I'm afraid I agree with the Bookman. I believe that the OP came on here looking for support and unfortunately when most people agreed with the buyer, then the buyer was 'transformed' into a monster. I'm not buying it either (no pun intended). The grammar, spelling and sentence structure are all poles apart I'm afraid hun. It's not the same person writing them...Sorry.

    yes, I did come on here for support, but I would never make up anything I have simply copied and pasted from ebay the buyer started of being very polite, although why she couldn't agree to receiving refund and keeping the dress and still opened a dispute I'll never know. I just know that although it's not a hugh amount of money in my circumstances to me it is a lot of money I have paid to post the item to her, lost the dress, lost my fees and may end up being taken to court. things are very bad and I was simply trying to get advice but after this I won't come on here again.

    simply refund her £6.70 and ignore her, what can she then do.

    No court would award her costs if you've refunded in full and let her keep the dress, and if she even took it to court you'd apply to have the case stuck out on the basis you refunded her and let her keep the dresss and she is being silly.

    However I agree with the bookman. The spelling of falsely in the rant version is very suspect IMHO

  • it would be easy enough to find out wether or not they actually said this. we can all see their ebay user name, so someone could alert them to this thread and let them defend themselves.
