I didnt just not turn up, I called to cancel. I was living in Wales and I've now moved back to Devon, so I'm guessing I should get in touch with the TRO here. I didnt pay the last months rent beause LL said it would be ok for me to leave and end the contract a month early (could obviously see there was trouble ahead). I moved out at the end of last month, so I dont owe anything.

The LL wont give me the address, not got my deposit back either.

Suggest that you send the following letter(s) with proof of posting adapted as necessary.

    Dear Mrs I N Hiding

    Letter before County Court Claim

You have refused to provide me with your personal address and I am therefore sending this letter to you at (address of old flat) as this is a business address of yours and also the address to which you require communications from the Land Registry to be sent to you. If you require me to use any other address please advise me of this. I am also sending copies of this letter to the following addresses (any known) where I believe you have other business interests.

You have not returned the deposit on (old flat) and as the money was not deposited in a protection scheme as is required by law, I am also claiming the statutory amount of three times the deposit. The total amount claimed is therefore £xxx which should be paid to me within fourteen days, failing which it is my intention to issue proceedings in the county court.

    yours etc

    Miss Newby

A few points, not in any order.

    1. The court papers can be completed on line. It's well worthwhile having a look but generally for a first time, it's better to do it in person.
    2. If a defence is entered by the LL the court will transfer the papers to the address where he lives.
    3. To enforce the judgment when it is obtained, the papers must be transferred to the local court anyway.

    4. Still keep up pressure with TRO and Health people about condition of flat.

    5. IANAL etc but bear in mind that whist very few cases actually end up in court, it is not unknown for daft judgments to be given.

Any comments welcome from other MSErs.

well i would suggest you must take care of some expert lawyer he can possibly guide you throughout the course. why dont you reach out to general public with your plea. issue the report in local news paper. some or the other way you will get the address of the landlord.
    best of luck :)

Thanks terry, I'll have those sent later today. Does LL have to have my new address? I left my guarantors as my forwarding address. As the deposit was paid into LL's sons account, could I ask for it to be paid back into my account, if not how? I'm guessing a chequeto my postal address

*edit* I'll have to send them monday, because the post office will be closed.

I sent the letter to the three adresses known by recorded delivery. One is being sent back to me, the other has been signed by someone unknown to me and the other has been signed by the LL!! I finally have proof of the LL's address! LL was supposed to get back to me within 2 weeks otherwise I'd be starting court proceedings. If anyone has any advice it'd be much appreciated.
