    only a county court can 'award' the statutory interest - but you can request it and the FOS will put it down as a repayment requirement if they uphold your claim

    So could i set up a company. Get myself into lots of debts and then only sell the assets and leave my debts to whoever.....
    there are a number of different types of sale

    1. from a going concern - someone wants to sell up so sells assets liabilities and good will,

    2. from a business in trouble - these companies are usually bought for £1 - sale of assets and liabilities - the purchasing company agrees to settle a companies debts

    3. company in administration - the receiver will attempt to sell the company, but usually will only be able to sell the assets - the amount recovered will go towards the payment of liabilities - usually in order of preference (paying the receiver first of course!!)

    Why do I need the settlement breakdown before posting letters? or is that just to work out a rebate.


    Will I need to send the settle breakdown off with one of the letter then?
    you really don't need agreement numbers etc. all you need to do is write a letter of complaint and put down as much information as possible (ie address at time of loan and approximate date) the company you're complaining to will have all the information - requesting a SAR can be time consuming and you need to get on with your claim - you really don't need a SAR to do this

    I did say a SAR is not needed but can be helpful if you want and they are putting in the claims before the SAR. The SAR is I assume is just for thier reference.

    I hope you saw what tiggrae posted after. You need to get on with the claims. Don't let requesting the SAR hold you up. As i said earlier, its not needed but can be useful.

    First just send the letters to both FIrstplus and Loans.co.uk. Tiggrae says you don't need the agreement number for Loans.co.uk as they should have all the details anyway. Just put down in your complaint letter as much as you do know. You don't need the settlement breakdown either before the complaints.

    You can request the SAR if you want for your own benefit but don't let it hold up the claims.

    Yes I agree, its a matter of choice with the SAR, with me when I did request this but i still cracked on with my reclaims.

    With me I needed to know the first loan amount when finished the first loan to go into a loan advance, as mine is being done through the FSCS and also registered with the liquidators, so come to think of it as the firms you use are still active they should be able to work this out for you anyway.

    So yep crack on with the complaint letters and if you needed the SAR for for your purpose then that is up to you (TheClarks)....;) , yet the firms should also provide agreement and the breakdown for nothing, but don't let that hold you back.

    Now that you have sorted out the first letter I would still get on with the first loan complaint.;)
