I think there may be a bit of confusion about the FOS - you have to remember they are a Government organisation and the Government forces the Financial Institutions to pay a levy to fund the FOS - they are totally independant of those financial institutions and believe me they hate having to pay the levy - also if an adjudicator says a claim should be upheld and the business refuses the claim will then go to the main Ombudsman who if he agrees the business HAS to pay up - it's legally binding on them to do so - personally I think they do a great job in difficult legal circumstances and if there is any area of doubt I believe they'll come down on the side of the consumer rather than the business !!

    Thanks Tiggrae

    Somebody needs to.

Hi, I have just received a phone call from this entitlements agency about my tax credit thing and they are sending me the cheque out now immediately. He said it was him i spoke to and remembers me cancelling and that he would do the cheque now. He then rang back and asked if we had actually cancelled this with HMRC as if we had then he would be £597 out of pocket. I told him i was going to monday so he then said it will first class and that he had it in front of him and it was their mistake and very apologetic. I have to trust him now to send me this cheque out???

If its not here by Tuesday then I am off to HMRC to get this sorted.

Thanks tiggrae for all your help here. I mentioned these things in a telephone convo that you said and look what happened. You're a star:A

just seems dodgy to me - did you get the impression he didn't want you to cancel the cheque as it would then be harder for the Tax Office to do something - why can't they do you a bank transfer - if both banks (yours and his are in the Faster Payments system) then you should have your money within 2 hours - did you ask about their claims management number ???

Endeavour only have until Tuesday since I sent them the first letter about the unfair rebate, the form partly already filled by the FOS, dates and new reaons etc, its just the rest I have to fill, best to make sure this is also worded properly, even though they said it is more than likely they will look at it because it was under jurisdiction when settled.;)

The FOS state to give them 8 weeks and that I have heard nothing up to now, not unless it was ignored again thinking it was still on about the mis selling, well if they had taken time to read it then they would have known nothing was mentioned about the mis selling !
May require your help here again folks next week if that's okay, I will let you know what I add and if it does not look right I rather you tell me.....:D , thanks folks.;)

What he said was we could do it two ways. Me cancel the cheque with HMRC and get another reissued or them pay me straight out by another cheque. He then rang back to ask if i had cancelled this with HMRC as if i had then they would be out of pocket by £597 and i have to say its true. Its a trust situation really as if i cancel it with HMRC and they have already cashed it then I have to start proceedings against them and also would HMRC do that?? Also if I don't then i have to trust that they will send me the cheque out. That is why i not jumping for joy yet. I will now give them until tuesday. I have now rang them back and left a message to ask for this bank transfer and will have to wait to see how eager he is to pay me. He sounded really eager and apologetic before when i mentioned that i have a complaint number with trading standards. What else can I do here....

Di, i thought you said yeterday that you had already sent your complaint for unfair rebate to the FOS and they had replied within two weeks??:confused:

No just thought you have not yet submitted them as waiting to hear first but you have had a complaints ref number just in case.

No hun sorry for confusing you.
A few weeks ago we had wrote to the FOS to make sure they can deal with our complaint of the unfair rebate, regarding Endeavour explained the situation that this was a brand new complaint and nothing to do with the other complaint about mis selling that they had returned to us.

( we wanted to double check this first).

The letter from the consumer consultant (FOS) came back through the post and not email, and they had already enclosed a form added the information in ready for me, new ref number etc about a new complaint with a letter to confirm this will probably get looked at because they were under jurisdiction when we settled and they added Nov 2005 in for me too.
They had done this ready for me to send back in case we have to get back to them, if not successful with Endeavour.

    Does that make anys sense.
I didn't want this one returned back like the last one about the mis selling but I didn't want to waste my time otherwise.;)

I have some lloyds complaints in with the FOS and have done for about 3 months.

Can we please have some more PPI reclaimers as I am dwelling on my own problems at the moment and I hate to do it. I always feel better helping with other peoples. :D
