    You was right in what you also said yesterday, the FOS NEED more staff to bring the waiting times down, it's just getting a lot damn worse, I was so frustrated waiting for just over a year last year:
    Nemo: Complaint was actually in with the FOS NOV 2006
    It was Jan this year when we actually received the money......:rolleyes: , we were very desperate....:o .

    Yes I did press for a receipt but don't think it works for other networks, but just in case.:D
    I think the difficulty for the FOS is that this is quite a specialist area and staff need to be both trained and qualified in finance and finance law before being able to work as adjudicators because that is where the main bottle neck is - after all none of us would want unqualified staff working on any of the cases

    I agree with Marshallka try to word it differently as the companies now notice the template letters so dig their heels in- but dont give up!!
    I would PM Tiggrae cos she is fab at tweaking letters and gets them by the short and curlies!!
    the FOS are great and yes it takes a long time but worth it both my cases for FP and NEMO have been upheld so I am really grateful to everyone on here who support you all the way at any time of the day.

    I recently took out a "secured" loan with Welcome Finance via an introducing company who sent me the paperwork for the loan, but it had PPI, which I specifically said I did not want. When I rang them back they said they would have to send out new paperwork which would mean the loan would take longer and may even be declined as would need to be a new application. Even though when I applied I said no to PPI.

    They said not to worry all I would have to do is once the loan was set up ring welcome finance and ask them to cancel it.

    Reluctantly i agreed to go ahead they payments with the PPI £476 (£20k), without would be £384. Obviously I would prefer the without payments as it is cheaper.

    Anyway the loan got set up and I did as advised and contacted Welcome Finance - they said yest ok and they would sort it. The first payment was taken out - with the PPI payment, I was fuming to say the least.

    So I contacted welcome again - and was advised that I had been incorrectly advised by previous person and the policy could not be cancelled over the phone, He added a note to say I wanted to cancel and that I needed to put this in writing withing 30 days.

    I have been so busy that I did not have time to do the letter.

    Can I still make a claim as I feel like I have been pressured into taking this out as they made it seem like I would not get the loan if I didn't take out the PPI with the loan.

    Any Advice please - I have made about 4 payments to the loan now and getting stressed as I am just about to enter a CCCS DMP as I am really struggling at the moment - If I stop PPI Payments that would free £92 a month which I can use towards my DMP and get those debts gone sooner.

    yes you can but you have to make it against the people who sold you the policy and you'll still need to cancel it with welcome

    So sorry to hear

    I know Welcome are tough cookies so you will have a bit of a fight on your hands but dont give up!!

    I would write to complain and put in the dates of request of the cancellation and what the sales person said if you had to wait for the new application without PPI I would request the telephone conversations too.
    They have to prove you were sold it correctly and you shouldnt have been mis led and mis sold.

    I am still waiting to hear if the loan company Eloan have been confirmed into default yet by the FSCS, although they have been good enough so far keeping me dated by email.;)

    Application form went into the FSCS a few weeks ago, but I know its only been the last few months that they have liquidized.

    I would just let FOS deal with this now and it seems to me like they have not read your letter. You have it in black and white that you had another form of protection and its still not done anything but i would add in your complaint to the FOS that they had not read it or even bothered to look. If you take a look at the link above about extra payments for stress etc then i would also ask that this be added as you have been made to feel a liar when you have this in plainly written on your Financial review form.

    I think if everyone started to ask for this when they have actual proof of the claim and the FOS asked for these "stress" payments as well then the companies might start to read the actual letters instead of just putting them to one side and sending out standard fob off letters.

    I recieved my statement from Barclaycard yesterday and they have refunded 120pds on to my account as this was their offer of refund of charges in a letter they sent I did write back and said I would accept the part payment in a cheque and the balance to be refunded as well in a cheque about another 500pds.
    no news on the PPI front but they are sending the rest of my SAR through- when I dont know.:wall:

    still waiting for the rest of my SAR which they said the other day will be here before 8th sept including the other 4 years of statements.
    no news on refund of PPI which I requested in Jan 2008 so thats why I need my SAR to see what the hold up is and what notes are on it.:mad:

    I would love some help and advise!

    I complained about two loans taken out with LTSB on 17 June 2006- one in 98 and the other in 02.

    The 02 matter was settled immediately by way of LTSB acceptance that they could not find sufficient details and so repaid premium in full.

    The 98 matter is a nightmare though! They did not pick up on the second complaint within my initial letter of complaint- since then have given 3 different reference numbers and I have had to fax a copy of the Credit Agreement in twice and twice by Recorded delivery- each time they deny receipt! They now accept they have a copy of the Agreeement and have rejected the claim, essentially on the basis that I accepted in the Agreement I had a copy of the t and c's of the Insurance policy (I never saw one), that despite the 'one off' payment I made not having a cooling off period I could have not taken out the loan or cancelled the loan; that as it is ten years ago they can't find details of when the loan ended, whether I claimed or had a rebate of policy as they do not have to keep records past 6 years blah blah. They say final letter and send FOS details.

    Should I go back to them with copies of my bank statements showing I paid every month till June 20 02 when I took another loan out to settle the first? (WHY?!) When I paid it off I was told I would not get a refund of the policy as already paid it. Technically I made the complaint within6 years and, in any event, I made it as soon as I became aware of the issues as to being misled. What really annoys me is that the say they could'nt find any info on the other loan which was why they paid out?!!

    Has anyone else been fobbed off by them like this? Any tips as to what you did?
