    Does this mean that they can be working on whether you actually have a claim whilst waiting for Picture to be declared in default or they are just accepting claims and will look into them once the default is declared (if that makes sense!)
    I would imagine if they decide you have a claim seeing as it is them who have to make the payment this would be quicker than waiting for a company to payout or is this wishful thinking!!

    To my knowledge, yes as soon as they are declared to be in dafault the claims will be investigated.;)

    Hopefully this will not be too long now - fingers crossed.

    Sorry about what I added in the forums earlier, I thought I had read somewhere it was confirmed, but I must have mis-read it.....:o .

    Just emailed the name at the bottom - it kept on coming back to me as error !!!

    So instead I went onto the website and emailed that way, I received an automated response, that this person is out of office until the 8th and will get back to me then.;)

    On Monday then with a bit of luck.....:D .

    Not heard anything from the other one yet though hun, you know the ones I have been emailing almost all day......:mad: :confused: .

    Me again,is there a letter I can send if a company has only sent one years worth of statements not 6years and a copy of a their current credit agreement not my original signed one ? Thanks

    Yeah, just state that in a letter and also state that you are going to report them to the ICO for non compliance with the Data Protection Act.

    I complained about two loans taken out with LTSB on 17 June 2006- one in 98 and the other in 02.

    The 02 matter was settled immediately by way of LTSB acceptance that they could not find sufficient details and so repaid premium in full.

    The 98 matter is a nightmare though! They did not pick up on the second complaint within my initial letter of complaint- since then have given 3 different reference numbers and I have had to fax a copy of the Credit Agreement in twice and twice by Recorded delivery- each time they deny receipt! They now accept they have a copy of the Agreeement and have rejected the claim, essentially on the basis that I accepted in the Agreement I had a copy of the t and c's of the Insurance policy (I never saw one), that despite the 'one off' payment I made not having a cooling off period I could have not taken out the loan or cancelled the loan; that as it is ten years ago they can't find details of when the loan ended, whether I claimed or had a rebate of policy as they do not have to keep records past 6 years blah blah. They say final letter and send FOS details.

    Should I go back to them with copies of my bank statements showing I paid every month till June 20 02 when I took another loan out to settle the first? (WHY?!) When I paid it off I was told I would not get a refund of the policy as already paid it. Technically I made the complaint within6 years and, in any event, I made it as soon as I became aware of the issues as to being misled. What really annoys me is that the say they could'nt find any info on the other loan which was why they paid out?!!

    Has anyone else been fobbed off by them like this? Any tips as to what you did?

    unfortunately you have a bit of a problem - the reason LTSB have probably paid you back for the loan taken in 2002 is they know you can take your complaint to the Financial Ombudsman Service - unfortunately for the loan in '98 you can't as it is outside of their jurisdiction timescale - you do have the option of taking your claim to the county court, but there are risks as LTSB could request the claim be statute barred (ie 6 years is the limit fore reclaiming under the Limitations Act 1980) however, there is a way of legally countering this (please see my posts yesterday) but it does have risks
