  • Thanks everyone, the wife is typing the letter up today, plus we will be adding a request for paperwork for the previous loan which we then extended to our current one, so we have two claims in fact.

    I wish you all the luck.

    You may find they will try to fob you off, but don't let that put you off, keep at them until you get a final response, hopefully they will uphold your complaint and refund you, if not as long as you have received the final response you can then complain to the financial ombudsman service.;)

    this is what some one said to me (on another site) when I started to have doubts the week before our letter to say we had been successful

    the FOS will NOT defend firstplus, their terms and conditions are hurrendous...

    First Plus already know this, i doubt very much they have ever had a complaint defended for them by the FOS...

    Add these to your complaints if they arent there already

    the policy is expensive
    the rebate is unfair
    even with the cash back the policy still costs more over the term than the original premium
    if you make a partial settlement you will have less life cover despite paying the premium up front

    give the FOS a chance to look into your complaint if you dont get a full refund -its a waiting game

    My postie lately is never before mid-day if any at all......:rolleyes: .

    I am wondering now if the compliance manager will actually send the response by hardcopy, though I did request this by email/attachment and normal post.....:rolleyes: .

    They may not send the paperwork out just like that. They may say that you need to pay them £10 for a subject access request.

    When was the other loan?? You may be best to ask for a subject access in order to get the details or just a copy of the agreement for the other loan which they sent out to me for free. It all depends on whether you want all the details or just the agreement.

    Also state on your letter if this policy was not offered "optional". Usually Firstplus don't give you the option.

    In the first part under the Data Protection Act 1998:

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

    Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

    If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.


    For the avoidance of any and all doubt, I reiterate:

    I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

    If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.





    I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

    I enclose the statutory maximum fee of £10.00 to access ALL data held by XXXXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

    You have 40 days in which to comply with this request.

    This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

    No postie yet or just no post today. He's usually here by now. I am sooo fed up of waiting (just like everyone else) here. Why doesn't the FOS do something about these time delay things. Perhaps it all needs an overall again???? After all we are all complaining about the same things.:D

    Did you request read receipt on the email today??

    It never works though as they always press no to them. I would get back by lunch again and say it a little sterner this time.

    When we're waiting for post we're waiting forever, its when we least expect it and/or a load of bills.....:rolleyes: .

    You was right in what you also said yesterday, the FOS NEED more staff to bring the waiting times down, it's just getting a lot damn worse, I was so frustrated waiting for just over a year last year:
    Nemo: Complaint was actually in with the FOS NOV 2006
    It was Jan this year when we actually received the money......:rolleyes: , we were very desperate....:o .

    Yes I did press for a receipt but don't think it works for other networks, but just in case.:D
