    Hi Di (oooh, it rhymes!)

Holiday was good, new job is interesting but exhausting.

Loan was taken out in August 2005, but I don't know if there was any PPI - I can't find a trace of it in the documents supplied.

When I asked for the remaining documentation, the reply was that it was outside the scope of the Data Protection Act, so they wouldn't give out the info
They should provide any documents that they hold of your dad. Was it a joint loan and did both sign the SAR as this could be the problem?? If you request a SAR and the loan is joint then both people have to sign the SAR letter as both had the loan.

Depends on when the loan was taken out. Some people are being offered a no admission thing of 78% but most complaints post 2005 taken to the FOS are being won. Laini won on here against Firstplus through the FOS and also another some months ago. Both complaints were a battle though through the FOS and they did not give it away so to speak. Just keep battling and don't give in. These policies that they sell are front loaded and also only cover 5 years of the loan. They cost a fortune in the end and should be banned. The terms on these policies are also not right in that you only get a small refund back if you cancel.

Let us know the date this was added and then we can look at some other cases on here and give you more of an idea.

Just an opinion of mine. ANYONE sold a Firstplus policy should be refunded automatically because of these terms. :D

    Good luck

I took this loan out in August 08 and posted it on this board yesterday

    thanks for you help
  • Hi Everyone,

I hope you can help...... my wife and I found out today that we maybe able to re-claim our PPI back from First Plus as we have an existing loan from them that we took out about 2 years ago.

The total borrowed was £50k but checking the paperwork today it would seem that the £12.5k PPI premium was added to this total too

Now we have read through the claim section and downloaded part 1 of the claim process/letter and created our points for a claim but we are unsure if we should add all three of the following or just the first 2 (hope that makes sense:rolleyes: ).

    · This is due to the fact that I was not given the correct information when the policy was sold to me, as
    • Your salesperson did not tell me that the policy was optional
    • Your salesperson did not give me full information on what the policy would and would not cover for example that the loan only covers the first five years of my loan term.
    • Your saleperson did not explain that the premium would be added to our loan.
    what are your thoughts?

    All help appreciated

    Hi hun

So it was only this month the loan was taken out then ?
    Or is the year incorrect?

I am asking this because if this is the case of taking this out in Aug 08, then there would be time to cancel before the payment actually comes out the following month.

Sorry if I have mis-read this one, but just thought I would mention this and I am aware that the FOS and FP are in dispute right now and it should be resolved soon, although it will not affect any claims/complaints.;)

    Good luck!

    Hi Michael and Deb.

You add as much information as possible, if those are the reasons you believe you were mis sold then you go for it.;)

Keep on at them until you receive the final response, if still not successful take it to the FOS.;)

    Good luck!

Just a quick reply as i need my bed but i would try to addapt the letter to your own words as i received my SAR from Firstplus and they had noted on their notes that i had sent in a template letter. Think of all the reasons that this was missold and most of all if it was a single premium front loaded policy and also if it only covered 5 years of the loan and not the full term. Also look at the terms of the PPI policy and these are not fair in that they say that the rebate on cancellation is going to be not in proportion of what you have paid. Go for the misselling but state it in your words would be my advice. Tell them that you did not know that you would be paying interest on the policy for the full term of the loan also when the ppi policy had finished.

Keep on and don't give up as this complaint is one that is within the jurisdiction of the FOS although the waiting list is a loooong one but worth it in the end.

    Good luck

Hi received an e mail back from FSCS helpline today. The advisor has checked up the info sent last week has been rcd. It has. He has spoken to team who are dealing with the case and has added extra info I gave him in my e mail to the file.He has advised me it is now being looked at and we should be hearing from them soon, together with an application form, if appropriate, to complete
Fingers crossed that think we have a case!! I have to say they have been really good with their responses to the e mails, responding really quickly.

Forgot to add on my last post to you, it is the actual ICO you would contact to complain.;)
