hey there, been reading through the info here in a hope that I might find a case simular to mine....so here goes
Was sold a Total Payment Cover...back in dec 2004, (over the telephone) have tried to claim back for payments I have made over a few years till I stopped it, july 2007 when I realised I wasn't even eligible (stay at home mum)
The company has said They were not regulated by the FOS until Jan 2005, literally days after I was sold it. NEVER signed anything or received any documentation about it!
Have put my case into the FOS, do you think I have a chance?
If not, what advise can you give please..

HELLO ALL, ....... Well, listen to this i received a lettter from teh adjudicator stating that he is now dealing with my case, and if there 's anythng else i would like to add etc, etc, so that was GREAT news to open that letter today, especially when i was about to post a letter to get my case fast tracked. anyhow i decide to give the adjudicator a call just to see when my deadline is for submittingh this info. I went straight to his line, and he picked, really friendly and helpful man, and he told me that he has wrote to BOS/Halifax and has UPHELD my complaint, i was over the moon. He said however he is just waiting for them to come back to him, cos they may say NO we are not having that,and then obviuosly thats a delay etc. theni told him about me conatcting halifax about taking the ppi off, and he said well to be honest they can only do something in the interim, because what they are going to have to do is restructure the whole 2 loans without PPI, and then also refund me for them, plus refund me for the other 3 i paid off early. again i had abig smile on my face, however, dont want to get too Excited until everything is finalised. so today the man calls me back from Halifax, about cancelling the PPI, but i was unable to talk as i was in a meeting, SO GUYS WATCH THIS SPACE!!!!!!0

Awww bless well thank you for all your support and encoragement,from all of you. well im hoping that if they do refund, they can pay it towards some of the loan, but then the ones that i have already paid off, i would like to expect that as a cheque,so we'll see Halifax are calling me back tomorrow,so would love to see what they propose, even though the adjudicator has stated thsi will probably only be interim measures what they suggest or offer, and thats ok.0

You can ask FOS if the dates are covered by them by making a phone call. WHen did you put your complaint to FOS??
They were fined by the FSA in 2006 by the looks of things here

I would have thought your claim will be ok as this would be claimable from the date that they came under the FSA being January, 2005.
Not too sure about before that date though. You will have to find out from FOS if they were members of GISC before.0 -
Yes I have told them all of this..but they upheld their decision and referred me to the Omb man...with their stupid leaflet enclosed!!!
