You can ring and ask but its a little too soon yet. I would have thought it will be ok as it was payable monthly but you may only be able to claim from 2005 but its better than nothing.

Going to call it a night now and be back tomorrow.

Thanks for your help this evening....it is kinda late huh, sorry
But that idea sounds like a goodie....I AIN'T GIVING UP THE GANDA YET!!!!

I'll await the letter back from the FOS and will let you know.

    Night....I haven't gone yet though..lolol
GISC stands for General Insurance Standards Council. Sorry forgot to add.

ok, so first thing I'll do is call 2moro and check the dates, I know i took it out on 17th Dec 2004...then ask if they are members of the GISC....Still a little unsure what I'm doing though...

What does the GISC have to do with it??? Sorry if I'm coming across a bit dumb..

Quote from one of their letters..
"Our records show that your policy was sold on 17th Dec 2004.
The FOS, which was set up to help customers with certain complaint, has only had authority over Redcats (Brand) Limited since 14th Jan 2005. Before this date the FOS will only investigate and assist with complaints regarding mis-selling of policies where the company was previously covered by other regulations set in the GISC DRF.
This means that the rules and regulation as they stand today did not cover the selling of your policy at the time you purchased it. As Redcats was not covered by the GISC DRF, We believe this complaint to be outside the jurisdiction of the FOS."
So they are NOT covered by the GISC.......So I have no chance then??!!
    Loophole search please....
A similar question was asked earlier regarding overdraft protection insurance that is payable monthly. I think we need tiggrae to answer this one. If they were not GISC reigstered and it was sold before the FSA took over then FOS cannot help but I remember Tiggrae saying somewhere (i think???) that you can make a claim for something like this from the date they did become under the FSA so ask FOS if its ok to make a claim from January (14th i think here) 2005.

I've been granted my court date in my case against the Halifax but I'd like to ask them for some additional information which may be useful in my case. Am I entitled to ask for additional info from (say) their Custoemr Relations team while awaiting the trial or does everything have to go through the court?

They seem to be relying on the fact that they've followed the ABI guidelines for insurance sales, but according to the ABI, at the time I took my insurance out, it was the GISC guidelines which they would have had to follow and this did not split between advised and non-advised sales.

I would like to ask them to show that their internal procedures complied with the ABI guidelines at this time (that original ABI comment coming from them), and also what their procedures are for document management as the writing on the CCA they provided is not mine. I also want to ask where the application form they provided complies with the CCA 1974 in terms of prescribed terms (as it doesn't have any!), and also ask for confirmation that Halifax Insurance Ireland are part of the HBOS Group (which their defence says they are not).

All useful questions I'd like to have some answers to. Can I ask it direct of them or do i need to go through the court?
Almost debt-free, but certainly even with the Banks!

It mentions them in this article as being part of the HBOS group:confused: (number 23)

Can anyone tell me if there is anywhere you can take a complaint for how little rebate you get if you cancel your PPI on a single premium policy?

FOS does that. Its the date that you settled the account that has to be within jurisdiction of them and not the date the sale of the PPI was made.

It's also on the front of the Halifax Insurance Ireland website that they are part of HBOS :D and also features in their shareholder reports :D so goodness knows what they're solicitor was thinking when he wrote that in their defence. Would be useful to get something from Customer Relations to waft in front of the court too which refutes that particular part of their defence.

They have said that there is no business relationship between HII and HBOS and that, in any case, my claim should be against HII and not HBoS (despite lots of people on here having goodwill gestures refunded on behalf of HBoS when the actual insurer was HII) . Again, their solicitor is onto plums with that one.

Haven't settled yet, just asked what would happen if I cancelled my insurance policy and from £19960 in insurance paid I would get back £2350 and my monthly payments would be £22 pounds less which I think is terrible!

  • Hi I'm really new to this and hope some one can help me. My husband has had a credit card with lloyds tsb for approx 15yrs. We have always had ppi on it until about 5 months ago when I finally realised it wasn't compulsory and cancelled it. I wrote to tsb and they sent me a copy of the agreement my husband signed for the ppi 15 yrs ago. My problem is that my husband has been unemployed due to illness for the last ten years so in effect we have been paying for something we do not need and have never made a claim on it for ill health. Is there any chance of reclaiming any of the ppi. thanks to anyone who can offer any advice liz
