my partner has just received a letter from financial portfolio who has said that after researching thier existing files and running his mortgage through thier loan checker system he has a claim.
Do we contact them or do we look into it ourselves?0 -
For Tiggrae, ( i posted this a few days ago so i thought i'd bump it back up)
I have just received another letter from Barclays re the PPI on my overdraft. They have said no because the PPI dates back more than 6 years (started in 2000) - can I not just ask for the last six years worth?
they state - "It is reasonable to expect customers to raise an issue within a reasonable time, after the event has taken place, our position has been prejudiced and the level of any investigation could have been compromised. Where a complaint relates to an alleged breach of duty outside the last six years, it is considered time barred under the Statute of Limitations".
I have only just found out about the mis-selling, and have therfore only just made my complaint, can I claim back just the last six years worth? What does the red bit mean??

use Civil Procedure Rule 18 (CPR 18) Request for Further Information - you can see a copy of this following the link from Her Majastys Court Service web site - you'll need to serve a copy on their solicitors stating you require an acknowlegement within 7 days and copies within 28 days - as well as internal procedures ask for copies of internal & external audit reports into their selling of PPI. Also send a copy to the court and ask them to lodge it on the court file

I have a problem with reclaiming PPI added to my Next Directory account since 2000.
Next have said a big "NO!" and the FOS can't help, so I'm not sure if there is anything I can do about it.

I would look into it yourselves.
surely they cant look into your details without permission from you?
Have you had dealings with financial portfolio before or was is it a speculative
letter.
I would ask for details from them what you can claim and how they got they got your details if you havent dealt with them before- as its your mortgage not theirs.

I think they are a financial advisors - dont quote me on it.
but dont you think if they have recommended the product they are now saying is missold and can claim on that surely you would have the complaint against financial portfolio not the mortgage company cos they sold/recommended it to the client/customer
