It seems to be that my complaint letter dated 30 July 2008 has not been read correctly.
Please read my letter dated 30th July 2008 again where you will note that this is about an “Unfair Settlement” which had taken place in November 2005.
I have enclosed a copy of this letter for your records.
As this event had taken place in November 2005 and not that of 2004 when it came to settling this product, I request for you to reconsider this complaint as a “New complaint of unfair rebate Settlement” and uphold this complaint as and refund what is due to me and that also of 8% of what a court would award.
Due to this reason of “unfair rebate settlement” and the misleading information on your letter dated 12 August 2008 I am aware the Financial Ombudsman Service will be able to adjudicate in this matter and also the FSA started regulating on 14 January 2005 where this definitely comes into regulation of Jurisdiction of the Financial Ombudsman Service.
Please refer to my letter dated 30 July 2008, and reconsider this request for a refund.
I look forward to hearing from you within 14 days of this letter.

A few questions I need advice on.
I am currently in the process of claiming back unfair PPI but also need advice on another matter regarding the same company if possible.
I had a Joint secured loan which included a legal charge on our property, after seperating with my ex-wife she restructured the Secured Loan in just her name signing new documents, she was given a new Policy number, documents and a new Legal charge was signed just by her.
However she failed to pay the morgage on the property and the house was repossessed allowing the loan company to claim their money on the secured loan via the legal charge.
The company however never discharged the original legal charge in the property and never presented the new legal charge in just my ex-wifes name to the land registry theirfore when the house was repossessed the share in the property which was mine was taken to pay of the debt.
However according to my credit file it shows the original policy as being settled when she resturctured the loan, however the new policy she only signed is on my credit file as a new debt even though I have not signed it.
First question is are they legallly allowed to ignore the new legal charge document and just leave the old one their or should that have been discharged.
Secondly, Why when I had not signed the new policy did the lender register me as being on the new policy theeirfore showing on my credit file as if the loan was joint.

I took out a personal loan from Alliance & Leicester in Dec 2001, i applied online, received a phone call stating i MUST take out PPI to get the loan approved.
That is all the info i have, unfortunately i applied just after leaving hospital after a serious car accident (hit by drunk driver), i took out the loan to purchase another car, dont know why i applied because i had 2 broken legs,a fractured skull & a brain injury?? there was no chance of me driving for months.
Because of the head injury, i have no idea or info on the loan details,when it started or finished or its ID.
I have written to A&L twice & have had no reply.
I need to trace this loan because i believe i was mis-sold the PPI because i was forced to take it out to get the loan.
My bank details do not go back far enough for me to find the payments taken.
Please can somebody help me to trace this loan info??

Yes you keep at them becsblade, you have grounds to complain here, mine and my hubbys is with the FOS right now for the same reasons as yours also Lloyds TSB.
How long ago did you complain to LLoyds?, if it were a while ago, say 6 months ago I would write back again and threaten them with the Financial Ombudsman Service, if this was not so long ago and they have supplied you with their final response then get a complaint form done from the Financial Ombudsman service.;) .

I have sent my claim into the FOS and this morning got an acknowledgement from them regarding this and my Redcats Claim too.
Lloyds Literally badgered me into purchasing PP on my credit card, the woman was so rude and did not explain my options at all! I stupidly fell for it!
Well anyway I did the template letters and got nowhere, the bums got in their final response after about 6 months of two-ing and fro-ing!!!
So I'm awaiting the outcome of the FOS (fingers crossed for us all huh) - LLODS TSB ARE the flaming cowboys!)
Thanks Marshallka and you too Di you two are our Champions!! And BeckiBlade too for your bit - hope you get a result.
Will be back and let you know my good, bad or ugly news...could be a while though, i think the queue is Growing as we speak! lol
Oh and ps. can i just call up the fos for updates, like for instance tell them I'd accept my claim from the date the FOS regulated them (REDCATS)? Thanks in advance0 -
