    write back to them saying you will only settle for 90%, also tell them that as their letter stated it was their final response and you're not happy with it then you're taking your complaint to the FOS - fill in the complaint form and send it along with your letter as 'a courtesy'

    do i write to black horse the loan providers or Lloyds Tsb Insurance? Also should i cancel the ppi now or wait and see what happens and should we settle first before this gets under way? If we settle first its gonna cost us more initially if theres no guarantee to get anything back iyswim
    you write to whoever 'sold' you the policy, put in your letter of complaint that you never wanted the policy and you also wish to cancel

    I would not mention your husband as he had nothing to do with this. Just put that you do not work and did not at the time of the loan and that it was totally useless. It seems cut and dried to me. Good luck.

    but at the time of applying for the loan we went in together and when they asked about earnings we told them it was only him working and the amount he earned etc.but the loan and ppi is in my name

    It does not matter if they said that. The point is the loan and PPI are yours. Your name is on the agreement and it was you that signed. It was you that the ppi was on so its you and just you that makes the claim. Its a classic case of misselling here.

    Thanks for this Tiggrae. I am probably being thick but can I just check where do I get the complaint form from and do you mean send it to FirstPlus or the FOS? Sorry - just don't want to get it wrong & end up with nothing! ;)

    I think she meant to send a letter to Firstplus about not accepting their offer and tell them that you are going to FOS. Then you download the complaint form from FOS site, fill it in and send it with copies of the letters you have sent to and received from Firstplus about the misselling. I am a little confused as to whether she meant to send in a complaint yet to FOS or to send it to Firstplus for them to see that you are actually going to complain to FOS.

    We are starting to see a change in the way the lenders and brokers are dealing with complaints. These companies know there are major delays at FOS and that you will eventually win, plus interest etc. So it seems they are offering less money if you want a cheque now and not in 6 months time!

    Thanks Marshallka. I've just had a look at the complaint form - looks pretty easy to follow. I think Tiggrae was saying send a letter to FirstPlus asking for 90% settlement and also enclose a completed copy of complaint form to FOS telling them I will take complaint to them if they do not agree to the 90%? (But don't actually send to FOS until I hear back from FirstPlus) Tiggrae can you confirm? Thanks!
