  • Sorry to cut corners but i've been right through the stickys and really don't understand alot of it any chance someone can give me a straight to the point answer please,

    my husband took out a loan in nov 06 we then needed extra cash so took out a further loan and consolidated the old one when we took out the second loan in dec 07 we were told if we didn't take the ppi we wouldn't be accepted for the loan when we borrowed the extra it was done in joint names but the ppi is in dh's name only, so what i want to know is we now have the funds to pay the balance when we get a settlement figure so is it worth paying it off then claiming our ppi back or claim the ppi then pay the balance, any advice much appreciated:D

    Its with Blackhorse btw and we desperate so accepted the ppi because we didn't think anywhere else would give us a loan

    It was the same for us hun, and this is mis selling.

    Personally I think that is up to you if you want to settle it now, because either way they would have to pay up.;)

    We were in the same situation as you, but what we done because we were so fed up with waiting and our mortgage deal ended, we wanted to remortgage to obviously clear the loans etc.

    Obviously we had to pay off the settlement which included the ppi, and then when we had finally won this they had a big payment to pay us back, it was almost £13K plus inconvenience and stress compensation on top of this again.

    Like I said its up to you hun, they have obviously pushed this on you with not having a choice in the matter.

    Please could you tell me if this was sold over the telephone ?
    If this is the case you could also request a copy of the phone recordings, it will and should disclose all the information on the sale of this policy.;)

  • thanks for the quick reply di but no it was face to face they said everything was done in branch now, do we have a good chance of getting anything back or could it go either way?

    Thats no problem - as you still have good grounds to claim.

    When you first write to them, most normally receive a standard fob off letter, but do not let this put you off.;)
    There are further steps to take.

    So get the letter done, post by recorded delivery hun, this way you will know it has reached the bank and they cannot deny receiving this then.;)

    As soon as you hear, then post back, with a bit of luck it will be good news, if not, don't despair we will go to the next step from there okay hun.;)

  • do i write to black horse the loan providers or Lloyds Tsb Insurance? Also should i cancel the ppi now or wait and see what happens and should we settle first before this gets under way? If we settle first its gonna cost us more initially if theres no guarantee to get anything back iyswim

    If the loan was totally in your name and not your husbands then the PPI too would have been in your name (it would not have been in your husbands???). This being the case then it was totally useless to you anyway and you have been missold. I would get a claim letter sent out immediately.

    absolutely, you have a very good case for mis selling !!!
