Only had an hours sleep last night due to my son with his special needs, so I obviously mid-read that link, and being so unlucky with the 2 that I have tried pursuing had dissolved or so.:rolleyes:
Thank you for confirming this, it did make me think earlier of why my letter to them was redirected at first when checking on track and trace, because I have never had this problem sending letters to them before.

I've had a PPI claim against Welcome in. It was for loans in 2001 and 2002 that were settled in 2003. I have been told they are not paying out. What is my next attack? I am claiming under mis-sold as I was made to think I had to take PPI to have the loan. Thanks for any advice. I believe I can't go to the FOS with this one ???0

The one in 2002 - What was the date of this one also?
Have you been told a final response from them or have you just found out that they are not paying out although you do not have to have final response to go through the courts.
There are always the small claims courts. Tiggrae is good for advice on this one if she is around later.0 -

Do you think it may still be worth Shamrock pursing the older one anyway even if the 6 years has passed ?, just in case......I cannot remember where I read it but I'm sure that I did read that someone tried their chances with reclaiming on ppi which was over 6 years and they were lucky enough to have a refund, not sure what amounts though.
It may be worth it or not I don't know......
But like you said Tiggrae will more than likely advise on this one is she is around later on.;)

Good News! I received an initial letter from First Plus about 10 pages long fobbing me off, we have reviewd all the phone calls, we sent you all the documentation blah blah blah! So I used the Letter 2 template and have just had another reply offering me an enhanced rebate of 78% (22% being held back for the provision of claims and administration costs).
"I would like to offer oyu an enhanced rebate of £1465.76 in addition to the £590.91 that will be applied to my loan account on cancellation of the policy.
I would point out that this additional refund is made with no admission of liability by either the insures or FIRSTPLUS and is purely a gesture of Goodwill. I would be grateful if you would confirm acceptance of this offer in writing at your earliest convenience."
I'm not sure whether to accept this offer or write to them again asking for more? 22% seems a lot to me for administration costs or have I got it wrong - are they being fair here? Also another question - will this amount be deducted from my loan or will I receive a cheque for this amount (which is what would have happened if I kept the PPI for the 5 years). Not sure I'm happy with the amount coming off my loan as I still have 11 years left to pay (don't intend to keep it this long) so would not make much of a difference - would be better use to me as a cheque so I could pay some off my credit card.
I am just about to send a letter back to FIRSTPLUS re settlement figure they have given me above to say that I do not feel this is acceptable but f they were to offer 90% of the insurance premium refunded in the form of a cheque as agreed when I initially took out the loan then I would accept this & consider the matter closed. However, have just noticed the last paragraph of their letter to me which says
"This communication should be viewed as our final response in relation to this matter, however, I must inform you that if you remain dissatisfied you do have the option to ask the Financial Obudsman Service to review your complaint. I have enclosed with this letter a copy of the leaflet "Your compaint and the obudsman" published by the FOS. This explains the procedure should you remain dissatisfied."
Is it even worth me sending this letter to them asking for a higher settlement or should I go straight to the FOS? Any advice appreciated!0 -
I have a had reply from HSBC advising that they will not refund any PPI as i signed for it. What can i do now.

ive been reading about claiming back ppi's that dont apply.i got a loan a few years ago.i dont work as im a full time mum.my other half earns the money.the loan is totally in my name even though it will be my partner who is in charge of earning the money to pay it back.we were advised to take out a ppi which covers if sick and off work or job loss etc,but obviously that does not apply to me as they knew i didnt work.could i claim the ppi back??0

Hi hun.
Now its time to move on, if that were their final response and you believe you were mis sold you need to keep fighting this.
I would either write back and threaten them with the FOS if they do not uphold your complaint or go directly to the FOS right now.

If you go onto the Financial Ombudsman service website there are claim forms on there and try to send as much copies of evidence as possible to support your complaint.;)

Hi there.
How long ago was your loan and who with ?
If before 2005 it can be a harder task to try to reclaim on this but still go for it anyway, the reason why is because not all loan companies were regulated until Jan 2005, where then you would be eligible to complain further to the FOS if these were regulated by the FSA or if GISC when you had taken out this loan.
I am still trying to pursue on some of mine that were before 2005, and have been successful in at least 1 of those which was actually taken in 2003.;)
Templates for reclaiming are on the main page, there is a list and examples of what is mis selling etc and a template, delete what does not occur to you.
