thanks guys! made me smile - you know how it is when you feel like you're getting all the work and then everyone goes home early cos they've nowt to to!
I used to have a very high powered, jet setting job -( but saw the light and gave it all up - too much travelling !!) the one thing I learnt is to NEVER EVER say anything in a meeting - that way you don't get any of the actions to do - try it Sarah and you'll see what I mean !!!:rotfl:

    Hi Marshallka hunni.

No news yet, I think I worked it out to be by Friday I should hear - hope so anyway.

I hope Endeavour treat this as a new complaint, as the first one was about the mis selling then told to pursue to Click who you know have dissolved, and this one is about the unfair rebate.
Still not sure if the FOS will look at this though, because they had already confirmed when I complained about Endeavour they were unable to look at this as they were not under jurisdiction then, but because this is now a total different complaint "unfair rebate" I am hoping they will.;)

I just hope my postie does not get muddled with the post again....

totally different complaint which took place at a different time - if you can't get your money back one way - then go for the other - after all it's not your fault that when you were 'sold' the policy they didn't at that time come under the jurisdication of the FOS but it becomes their problem that when they stung you for a low rebate that they did !!!

The limitations act is 6 years but this 3 year thing is not something that they should state. I did not know about these types of policies and that is that.:D
the reason why they mention this is it is part of the criteria that the FOS look at when considering a complaint (ie there are 3 dates on the compliant form - when did the action take place, when did you first realise it and when did you complain.) Therefore, in the additional information section I always add that although the 'sale' took place a number of years ago my client only just recently became aware of the possibility of mis selling due to media interest

The one I thought was 2002 is actually Feb 2003. Got a letter today and it stated Final Response. However phoned the dept dealing with this and put a a case forward for the product mis-selling. The chap was very helpful and asked me to put it in writing and he will investigate further as my points were very valid?? Thanks for all the responses guys!

I have put on my complaint that i had no idea how these policies actually worked. I was told by Firstplus that it was because of rule 78 that my settlement was high and until this day i did not know it was actually because of these front loaded single premium policies.

Probably going to have to re do these complaints though as i put two on the same form.

    Hi Marshallka & Tiggrae,

    Barclay ppi..

Finally had a phone call from FOS, the guy on the phone was useless,

He said that i cannot have ppi from barclays paid into my account as it all needs to recredited and restructured into a new loan.

So all the ppi that they owed me will be taken off with a new loan of £8.400.00.

My question to him was why can i not have the cash back on the loan payments that i have already made.

    Can they do this..

I was hoping to get some ppi back credited to my current account.

This is for the 28months payments already paid.

    Please advice..

    Thanks

They usually pay it back as a cheque. Have you defaulted at all on the loan ?? I have not heard of this before but perhaps tiggrae has.

Did you stress to FOS you wanted the money YOU had paid in a cheque???
  • Finally sent the last of my complaints to the FO so just a waiting game now...........maybe sometime next year I will be lucky!

    Good luck angelwillow.;)
Hope it all goes smoothly for you from here, it may be a long wait but hopefully it will be resolved when it goes to the adjudicators stage, as mine even went as far as the ombudsman himself as it was rather complicated.....a bit like all my claims lol....:o :D .
