    Hi Di, dontg worry about it hun, yea ive JOINED the club, but i must say the guy on the phone from the customer relations team was VERY helpful.lol, so i will keep you posted, because they are meant to be getting back to me tomorrow.x

    Seems like you got stung with rule 78 here and also a front loaded policy by the looks of things. I take it you are going for misselling here and not unfair rebate??

    Sorry I know I am being a pain here but want to do this right! I will send letters to both - shall I tell FirstPlus I have sent complaint to FOS already or just say I am going to if they don't give me what I want and see what they come back with? Also if I am going to FOS anyway is it worth trying for 100%? In which case do I go back to FP asking for 90% but in the complaint to the FOS go for 100%? (Can I do this?) Sorry it's just all confusing me! And I certainly don't want to end up with nothing by messing it up?! Thanks for all your help - really appreciate it. :D

    well today i rang halifax to cancel the PPI, and they said that i might have to take out a different loan for it, or they were going to try some other way, but this needed to be dealt with by the 'Redress team' or some name like that, the fact is i have 2 loans, both which finsih in 2010, i would love to see what they will attempt to offer, consdering they know my case is with the FOS, and know it has been since jan 08.

    sorry forgot to ask are banks going straight to customers now with an offer? is this somethig thats happenng?

    You only took this loan out with them 2 years ago and told them you did not want the policy but they still insisted you have it with their sneaky sales technics. I would go for the whole amount here and forget the 90% business. I would just write to them again and state you want the whole amount back. Did you ask for this whole misselling your initial letters and if so then i would just send them another letter to say you are now going to FOS for misselling and it IS within their jurisdiction as it was only 2 years ago and then i would start the claim off with FOS as well. (start your claim with FOS as FIrstplus have given you a final response to a letter for the WHOLE amount of misselling).

    I don't think tiggrae realised this was only 2 years ago and that you had stated that you did not want this policy. She would insist you claim the whole lot back i thinks.

    I have just looked back at all your posts and I would definately go for the whole amount and the interest etc. They will rip you off otherwise. Its what they do. Get your complaint into FOS as soon as possible and let FIrstplus know in the meantime that you have now taken it to FOS and are not accepting their offer at all. You are adamant that you WERE missold this. Keep the letter short and to the point to them. You are still allowed to keep in touch with the business even if your complaint is with FOS but sometimes the firm (Firstplus) won't respond to you as they have already given you their final response.

    If you are happy to accept the 90% then its entirely up to you but i would go for the lot.

    Some banks are using the desperation thing now knowing that FOS is six months behind so its up to the individual and how soon they want their money. Lots are making offers of lower figures and goodwill gestures in the hope that people are desperate enough to accept it.:mad:

    Lol they are sneaky! Yes I have gone for misselling in all my letters, and although in their final response they stated that they were not accepting liability they offered me the 78% as a goodwill gesture (however this was after a second letter from me - the first response from them was a resounding NO, they hadn't missold me the policy or done anything wrong). Surely if they have offered me 78% as a goodwill gesture they must know they were in the wrong? I'm scared if I go to the FOS for the 100% that I might lose all of it - that's where all the 90% business came from - me being scared if ending up with nothing!! But if I've got a strong enough claim then I'll do it. I'll write back to FP telling them I want the whole amount and also start the complaint with the FOS.
