I have just sent my DPA SAR request to Lombard Direct with £10 postal order (to find out whether or not I have been charged for PPI.) They could not tell me over the phone because my accounts have been closed (I have had two loans from them in the past) and have asked for all information they have on me using a template. I know they have 40 days to reply, do they usually take this long?? I have also sent it recorded delivery so they cannot turn around and say they have not had my request.
Could you not request a copy of the agreements instead and see if there was ppi on them??0 -
we had an horrendous loan via freedom finance but from first plus. good news - we scraped enough together to pay it off last year. bad news - tried to reclaim PPI payments back (actually missold on not one but three areas) but have had the boot arounf between first plus and freedom finance each blaming the other and nobody taking responsibility. Then freedom said to speak to their parent company Bespoke - they are based/holed up in gibraltar. We contacted them but they basically told us to P**s off that they were not responsible for 2 reasons - one - we took the loan out in august 2003 - before any legislation came in - and two - they are in gibraltar - 'nah nah nah can't touch us, we're not controlled by the FO coz we are off-shore dancing on a rock' (you get the picture).
we are very disgruntled and don't know where to to turn now.

I took out a loan with Barclays in 2006 and had front loaded protection added to it. Nearly adding another 25% to what I pay back.
Anyway, I complained that I was missold the policy for the reasons below and they have written back saying no way am I getting my money back. They say, and have proof, that I agreed to it and they were following all relevant compliance. I have seen the signed documents and it appears that they have me bang to rights which is pretty annoying. I do not remember agreeing to this, though I must have.
· your salesperson implied that taking out the policy would assist my credit application.
· your salesperson was very pushy in selling me the policy so that I felt I could not say no.
· your salesperson did not give me full information on what the policy would and would not cover
· I am concerned the sales assistant that sold me the policy has no financial background and the policy was not sold in my best interests.
· The policy was not explained to me in a clear manner and full details of the policy were not disclosed at point of application
Is there anything else I can do? Is this just a stalling tactic or am I screwed? Are there any other avenues to take?
Any help will be greatly appreciated.

Yes there are a few avenues to take from here hun.
Was you sold this policy over the telephone ?
If thats the case you can request for a copy of the transcripts, /via Telphone recordings etc, if they do not supply this then I would personally request a SAR (Subject Access request) for £10, the template is here on this site, if you cannot find it let me know and I will post up, I did add one the other day, but I also have one from Laini, another helpful member here, I will post up if you need me to.;) (hopefully they will provide the recordings free of charge, give them a ring first and see what they say).
By requesting this they have to provide everything they have on you and must comply within 40 days deadline.;) (send by recorded delivery so you can keep track on the time they received it by the royal mail website).
If this was the first letter, I would write back and complain to them again and tell them if they do not uphold and refund you your ppi premiums plus 8% of what a court would award, you will take further action, such as to the Financial Service Ombudman for further investigation. (I would give them 14 days myself, but some companies require more time).
Do not give up, this is more than likely a standard fob off response.
Keep going with it Jimmy, you will eventually get there.;)

Thanks to Di and Marshalka for your responses - you've shed lots of light for me. Will keep fingers crossed for a speedy response from Halifax with a cheque for the right amount! Will keep you updated.

You could always try google search and click in 'PPI mis selling Picture" and the same with the other company.
Meanwhile good luck with these companies, hope you win, but if not successful go on to the next step by writing again, threaten them with further action, when you finally receive the final response and still not successful then it will be FOS time if these companies were then covered by the FSA etc.The one and only "Dizzy Di"0 -

Talking about posties I went chasing after mine today, I must have looked a right state, wet hair, almost dressed....:o , slippers......no make up on....:eek: , lol.
I passed him back the neighbouring streets mail and made him search in his bag for the correct post (my post), he passed me mine and looked like this.....:o , said "sorry love", I did go a bit sarky on him and ask him if he normally wears glasses.....:cool::rolleyes: , he did not say a word, and I said if this happens again I will be ringing the manager, he stuttered something and walked off.....:rolleyes: .
Anyway, there was nothing exciting in the post he gave me, but my son's hospital appointment, if that had gone elsewhere then I would not have known anything about it......:mad: .
The last time this did happen, was with a different postie, the manager sent me an apology letter with a book of 6 first class stamps........:rolleyes: , now isn't that exiting? - not !!!:rolleyes: .
we are still getting our post at 3pm:eek: :eek:
Di I have been looking for you to ask the following;
how long did it take for the adjudicator to pass your file on to the ombudsman and then how long did it take for the ombudsman to make a decision on your Nemo case?
Would you recommend me to email our adjudicator to ask for an update or do I just wait?

i've had the same with Firstplus, in both letters they state that we agreed to the PPI - we didnt, it was all done over the phone, so I have sent details to FOSDEBT free:j0
