I have kept all correspondance, I have it right here in front of me now. So basicly, what your saying is that I should resubmit my complaint to the FOS? How do I avoid going into a lengthy queue? And what do I need to quote to ensure I dont get rebuffed again? Is there some code of practice from pre 14th jan 2005 from the GISC that will give me some back up? Cheers! Its beginning to turn into a nice ending to my day!

    Right hun
To get this resubmitted I would write a letter to enclose with the form, and tell them you believe there was a mistake about these not being regulated, as you are aware that they were covered by GISC (Hopefully Marshallka will give you the dates).

And because you have already waited for this to be passed on since XX/XX/XXXX you would like to request for them to put this on a fast tracking system as this was no fault of yours of why this mistake was made.
(you can also request this anyway if in any financial hardship).;)

I do know there are procedures they taken from when the forms are received which is normally left in a pile until you receive a letter to let you know they have received your complaint, then the next letter is normally to tell you that this is waiting to be passed onto the adjudicator, as you know.

So before it actually goes to the adjudicator, that must be when they check for them first to make sure the complaint is eligible to get looked at, then the waiting pile for the adjudicator, so in your case I assume it was just in the checking pile.

I'm sure Marshallka will also guide you through this.;)

Marshallka if you have posted while I'm writing this......please accept my apologies.......:o :D;) .lol

    Hi di3004.
The loan is still active have about £1500 left to pay finishes Apr 2010. I don't think that they would have just added it probably me just not noticing! I can't find the paperwork so the template would be great. Do you know whether this far back it would have been a condition of the loan as some people have mentioned? Would this be stated in my paperwork.
The template letter would be great.
    Thanks

    Thanks for confirming this hun.

Right here is the link for the reasons of being mis sold and on that page you will also find a link for a template.
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance

Add whatever reasons why you think this was mis sold to you and use the template to help you, add more info if you need to.;)

I would still get the letter off to them, and they have 8 weeks to reply to you, do not worry if unsuccessful first time round, another letter for reconsideration can be sent.

Still sent the letter off and you can always contact them to see if they can supply you with any agreements free of charge, or they may make a charge of up to a £1 for them to supply this, however, they may send this back with the first response letter your receive from them.

Some companies will go back more than 6 years, some do not, but if you don't try you will not know.
Try also checking on the success forums for anyone else in your situation with the same company.;)

    Always send by recorded post.

Please keep us posted and if you want to know anything else just give us a shout.

    Good luck
    Di.

    Hi all,

Not posted on this thread for months, but need some advice.:D
I had a loan with RBS that finished over 6 years ago. Wasn't going to try a reclaim as I thought it was too old, but i've been sorting out some old personal paperwork and have come accross the original documents for the loan. Is it worth trying to reclaim and can the FOS help if it is so old? The loan was taken out in 1999 and paid off in 2002. The ppi loan was a single premium of £1250 so it's not chicken feed as i'm now on a DMP, and RBS are one of my creditors albeit in the giese of Mint and Tesco finance so could go towards paying them off.

    Any advice appeciated.

    Cocker :)

    Hi Cocker.

No matter how old in my opinion, I would still go for it and see what happens, I have known some to be both unsuccessful and succesful in reclaiming old loan ppi's so give it your best shot, you may be surprised.

Check this out here, where there is a template to help you through this.
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance

Add as much info as you can, and you should receive a reply by 8 weeks, take it from there, and if we need to take another step further then we can keep trying.;)

    Good luck!

Just exactly the same as they did to me but it was 8 weeks later I resubmitted and I then had to go back of the queue again. I told them this last week and it made no difference to the, They just said tough basically. It was not my complaint I am beginning to think now. It was their fault. They wrote exactly the same words in my letter too.

They stated in their letter to me that the complaint for unfair settlement in 2003 was outside their jurisidiction as Firstplus financial group did not come under their jurisidiction until 14th January, 2005

You can try on this one but don't know if the FOS may throw it back to you if they were not members of the GISC at that date and don't know if the gisc existed then. There is also the banking ombudsman too that the FOS could consider complaint under but don't know if they were members there. ALso the bank may say they no longer have the paperwork and the settlement of the loan etc. Do you have the actual settlement of the loan too? It may be handy here as well as the agreeement. Tiggrae always says that as your loan was in 1999 that the FOS would not be able to look into this but you could give them a ring and check this out first. They will tell you straight away as it can be a stressful thing to go through if you get to the point of a final response and then FOS knocks you back as well. There are always the courts though.

    Good luck.

I started a claim with Central Trust 18th August.
I took a loan out with them in Dec 2003 for 15,000 the PPI was 2422.49. They have written to me to say that at this time my PPI was not regrulated with the FSA and that they sent me insurance documentation and that it would be down to me to check that this policy was suitable for my needs. They are therefore not paying out for this PPI. I have looked at my documation and do not have any insurance policy details. Don't know where to go with this one.
I took another loan with them in May 2006 for 17,000 the PPI was 2735.89. They have offered me a full refund for this as their CAM did not ask the correct questions.
I don't know if this is a success or failure!!! I don't know wether to accept or refuse this offer???

Was the second loan to pay off the first??
No-one can tell you whether to accept or refuse but I would send a letter in again and tell them that you are not happy with refusing the first loan and you will continue the complaint to the FOS if necessary. Idon't know if Central trust were members of the GISC as this complaint was 2003 so before the FSA took the reins. I wonder if you can perhaps ring the FOS and ask them tomorrow if they were.

    Hi Mags

I see Marshallka has given you some useful guidance with this, and here is the tel number for the FOS in order to see if they can check if the loan company were under GISC for when you had taken out this product, they may confirm if they are also able to look at your complaint if no success from the company.;)
    FOS tel no:
