I took out a loan with First Plus on which I was sold PPI that I didnt really understand, want or need. I have tried to make a claim against First Plus as I feel I was missold this Insurance. I got nowhere with First Plus so approached the FOS. They have written back telling me that as the loan was taken out prior to First Plus joining the FSA on 14th January 2005 they were unable to investigate my claim.
Has anyone else experienced this? More importantly has anyone gone on to succesfully challenge First Plus and reclaim insurance payments?
    Many Thanks Steve
But Firstplus were members of the GISC at 20th November, 2001 so it is under the juristiction of the FOS if your loan was after that date.

Did you make your complaint for the misselling of the PPI with the FOS. They have made a mistake here for definate as I wrote and asked if they were members of the GISC (which puts them under the jurisdiction of the FOS at that date) and they emailed these details back to me.

    Hi Steve

Right do not worry, I know its very annoying, the same thing happened to our Marshallka here who will probably explain her situation.

However, when did you settle this loan if settled yet ?

If you have you could try for the unfair rebate, as I know these would not give much in a loan/ppi rebate anyway, so if you could let us know of when you had settled (if settled) (the year), we can take it from there.
    Thanks.;)
Di, this is crap that they were not under juridsiciton. They were members of the GISC in November, 2001. If this loan was on or after 20th November, 2001 then it is under jurisdiction.

Di, don't really know what to say here but it needs sorting and you will do it I am sure. I raised my son to the age of 10 on my own and must admit it was hard and he does not have special needs but had been through a lot and it is hard to see your son suffer. Do you know the lads name and his parents. Perhaps you could have a word about it as well as the LEA.

Thanks hun, yes your right, it needs sorting once and for all, so not going to send him back until they promise this is resolved.;)

Yes you have been there yourself haven't you hun, on your own and your right its always tough work and tough on the kids, I know with my older son I split from his dad when he was about 3, but always had support with my with him really, and I suppose at least hubby is with me with my youngest, because I know I would not cope at all on my own to be honest.

Yes I do know the lads name and the parents are not good either, and a letter will be going into the LEA tomorrow.;)

But the thing is there are so many bullies, my son has been under the hands of, and so many to list but this one today, is defo the icing on the cake sort of thing, its the final straw.

Good, glad you cleared this one up then hun, I was not sure for certain, and knew you would confirm on this.;)

So this was thrown back by the FOS again, this is so wrong, why are they not able to deal with it then ??

Just found my email now from the FOS about FIrstplus. Like I say if your loan was on or after 20th November, 2001 then they have got this wrong here.

    Thank you for your email.

From the information you have provided, it would appear that we cannot deal with your complaint because the business is not covered.

Having looked at the information you have supplied to me, it appears that your complaint against Firstplus Financial Group relates to events which occurred when it was not a member ofthe General Insurance Standards Council (GISC).

On the 14 January 2005, as a result of recent legislation, the Financial Ombudsman Service became responsible for looking into complaints against former members of GISC about events that occurred while the firm was a member of GISC.

I should explain that the firm was a member of GISC from 20 November 2001. I note the policy was sold to you in January 2000. The complaint therefore appears to outside our jurisdiction.
  • The loan was taken out on 9th jan 2005 and paid off in November 2007. I have been trying to find the GISC website, do they still exist, would they be likely to investigate? cheers! Steve

Di not wishing to teach my granny to such eggs as such but if the police get involved now it will show the rest of the bullies and the school that you are not willing to accept this. As I am sure you are not.

My guess here is that FOS had made another mistake. If this loan was after 20th November, 2001 then again they have made this mistake and this needs sorting.

Steven you should re-submit this and tell them you are aware this was under GISC a the time you had taken out this policy.;)
Marshallka will guide you here hun, as she has experience with these herself.

    Good luck.
