Still trying to suss out that settlement I would imagine. Did you send that statement to them...

Yes maybe but I asked them if they wanted the settlement breakdown the last time and they said no, as they would be getting that info when they investigate and have the details........
They state they have only now started the investigations.

So if the only thing you have sent to them is the agreement and the liquidators have not got any other stuff how will they know when you settled and how much you actually paid etc...I bet they will need it then.

    Pm'd you Di.,.

  • Hi

I have started taking PPI action against:
    Egg CC
    Capital One CC
    (both now closed)

    Egg Loan (since 2006)
    HSBC Loan (since 2006)

so far so good - however I have experienced the following two problems:

    1) Egg CC have written back to say that they want £10 from me for them to send me my previous CC statements, I had assumed that this was free under the Freedom of Info? If it was the loan I would understand as they'd need to access my transcripts etc... but for previous CC statements.

    2) for capital one CC, they have sent my my statements, however no where can I see any mention of "PPI" in the charges. Could it be called something else on the statements? And if it's not explicitely stated, does this mean I was not charged PPI?

thanks in advance for your help!!

    Hi there Ali.
And the very best of luck to you hunni, its your money so get it all back....:j :D .

Basically I did have a very complexed complaint against a loan company of Nemo personal finance, they denied mis selling this went to the FOS in Oct 2006, we were finally paid out Jan 2008, okay it was well worth it and not far off £13K was refunded back on this one.;)

Yet another one of mine, was with Liverpool Victoria, this had only taken a few weeks, even the first letter, they replied back within a week and admitted that this was possibly mis-sold, even though not a large one it was not far off £2K refunded. (so no FOS with this one).;)

Now onto other cases I have a few Lloyds loan ppi complaints to get on with, I have slacked on this one, but its going to be sorted out now this week, the letter will be sent, and the FOS is dealing with a Lloyds Credit Card ppi right now with is actually with the adjudicator.

My hubby has 2 of his Credit card again lloyds ppi with the FOS right now but still waiting for them to be passed on to get looked at.

We have an Endeavour complaint in to the FOS, but only in the beginning with that one really.

I will post up as I go along - as when I hear something.

I do hope you get all yours back without an hitch hun, good luck !:D

Wow, Di, £15k back so far? That's awesome!

From reading other threads in parts I and II it seems the questionnaires are an attempt to find one shread of evidence to not cough up. So I think I'll just return the document with the lovely Martin's second template letter... Has anyone else been successful doing this?

Thank hun, yep not bad going is it? lol.....:D :j .

I think your right about these questionaires, the way I see it though they already know due to the letter sent and I think they think its something that would put us off, but not a chance......:D .

Yes I believe there are many who have been successful the 2nd time round of the letters, the companies know its the last chance they have to reconsider and some do not like the thought of the FOS dealing with the complaints, so yes I am sure there are a load who have been successful.;)

Hope you get through this too hun and you will just as long as you keep at it, and you do seem to be very eager, so you have a strong chance. ;) .

I had added a SAR (subject access request) letter on here which is just a few pages away, that is what you would have to send with a £10 cheque payment in order to receive everything they have on you on that account.
They have 40 days to do this.

Now hun, do not bank on me, but ppi can be called various things, like PPP for example, maybe someone could confirm this to you.

If you are unable to find the template let me know - one of us will re-post this up for you.
Good luck, just yell if you require info.

I hope you get somewhere for your mum. Its not nice to have your mum being fleeced.

    Hi
:j Hurrah had success for my mum at last but not without a fight!

After we sent the original letter of complaint, citing that in offering a new rate of 19% they were not complying with the FSA guidance. Barclays replied and quoted the terms and conditions of the original loan where it does state that they "cannot guarantee that the new loan rate will be the same".
I sent another letter back to them stating we were not satisfied they had answered the complaint as there was not mention on FSA guidance in ther reply. We gave them 7 working days to reply and asked them to state if it was thier final reponse and on the 14th (the final day) they replied to my mum saying yes she was right, she could cancel the single premium policy and the new loan rate would be exactly the same as the current and she'll have about £3000 back! Shes waiting for the paperwork at the moment but has had all this in writing from them.

Its great news but i hate the way they try to flick you away in their first reply. It was obvious from the start that they werent acting fairly but they didnt answer that in their first letter. Im glad for my mum that I stuck to my guns. :D
Thanks for your advice it was really helpful.
