    Wahoooo

The adjudicator has just called me and said that he understands my complaint fully now and has stated that I made a very valid statement in that accepting this offer this would be in full and final settlement and that would include the other loans too.

he has now 100% stated that all four are being looked into and that he has tried to call the co-op today but had to listen to music and answerphones etc but he is going to get back to them and when he has another offer (if they do of course) get back to me....

That is all I wanted, a fair argument and him to adjudicate. Just have to wait now and I have told him i will not pester him again.

He has emailed this as well

I have passed the information you have provided to the Co-op and I am awaiting its response. Please hold the settlement form for the present until I can confirm whether or not they are going to make goodwill gestures on the other 3 PPI sales.I am considering all four loans under the above complaint reference.

Thank goodness the sun is shining on you this morning:T:T:T:T

Marshallka I think they must have been reading this site......:D , I think its great news and it will give others hope too hunni, I am sooooooo pleased for you, you have had a very bad time of it and now hopefully everything will start going your way - at last.:T

I do have a very good feeling about this now, well if they have already offered an amount, although they may not have admitted it, but I feel your adjudicator will know these were mis sold, if one was then they all were....:D , WOW, all that money - its yours hun, and it should be in your pocket...:T , now we will keep everything crossed for you, its about time things went your way - especially as you do tend to help others win, now its your turn  .

I only wanted a chance like everyone esle.

This new adjudicator is so nice and friendly too. I apologised so many times and he was " don't worry- you have detailed this well in your email .... you have made a valid point of accepting the offer and I will now ask them for the others to be considered under goodwill".

They can ague them of course but as they were part of the banking ombudsman scheme at this time certain codes can be applied and I found this out from google. Like i say nothing is definate but at least they are trying.

Don't think I will get anywhere with the unfair rebate with FP though. Unfair rebates are hard to prove. I have not heard of anyone on here or other forums actually winning on just unfair rebate. I am going to google this and look at other sites too. Tiggrae had some complaints in for this but not heard of any winning...

Maybe its just as well you have a new adjudicator then hun.....:T , this person seems to have understood you, excellent.:D Yet it was clear enough anyway.

I suppose I will soon find out on mine about the unfair rebate/settlement, even though they had added this on my form as a brand new complaint and had put it down as unfair rebate settlement - fingers crossed.;)

I think yours may be Ok but mine is apparently waiting with a manager to see if in fact they can look into this type of complaint so I am told. I have not seen anyone though Di. Have you ever seen anyone post about this??? I was told by singlep that the unfair rebate ones are the same type of complaint as misselling in that the date of sale is the main point in question. Tiggrae said different but looking at it now, they have not moved anywhere with mine and that is my final one then. I just wish they would say one way or another. I think they can look into unfair rebate and if they were members of the GISC at the point of sale they will look. Like i say that is what singlep told me and then we had all this conflicting advice. Maybe I am just being negative here but time will tell if the point of sale is the point that matters to this type of complaint. Not had any update on this but did ring again yesterday and was told to ring back friday after lunch and maybe after the manager had looked at it they would say if this is a complaint that they can get involved in. The others have been scrapped now and it just the unfair rebate one.

The only thing that can be applied to this one with FP is the GISC thing as they were not a bank and nothing else comes into it.

Good luck on this one too then hun.
When did this one go in to the FOS now (the recent one then) ?

Endeavour were not covered as you know until Jan 2005, but the one from the FOS had put in the date Nov 2005 for me and the heading as unfair rebate settlment, so time will tell I suppose. Just must hope but not banking on it..... , so I have kept my mind open just in case.

OMG, my poor neighbour had his car broken into last night, the wires from all under the steering wheel ripped out, they must have tried to start the car but were not successful, but had taken some items from his car too, his car is only 2 years old and my neighbour he is my age, but disabled..... , we were very lucky I suppose, but then as we have a Subaru Impreza, its fully alarmed, tracker the lot, its my hubbys baby and he has had it for a few years now but worked like h*ll for it at the time, and my son's car was parked in with these too, luckily ours had the heavy duty steering locks etc and alarmed, but still its not nice is it, so the police etc will be in the street shortly to do some checks.

Its not the thing that happens around here normally.......

Just received a letter from the FSCS, they are again requesting for further information ! (Twopart/Eloan).

Now why did they not request for this when they requested for a document of the name of the company last time ?

They are asking for a copy of the payment protection insurance certificate, but I had sent the agreement, wouldn't that be it ?

I mean what else in certificate am I supposed to provide ?
And any other documents from the insurance company !!

    Any suggestions ?
I am baffled, you don't think they mislaid what I had sent them do you
I thought the payment protection insurance certificate would be that of the agreement, I have nothing else !!

  • Hi all

Just had a letter from the Halifax saying they are upholding my complaint, for PPI on 2 credit cards dating back to 1999. After sending off the initial letters was advised I would have to wait, and like other people they made me wait the full 8 weeks.

The letter gives the usual blurb about not admitting liability, and has only been agreed as i am such a good customer, I will have to wait another month for the payment to be made.

The issue I have is they have said that if I have an open credit card then they will pay the money into this, if not i will be paid by cheque.

Surely if it is my money I can ask for it to be paid to me any way I want, can anyone advise where i need to go with this, the amount should be around £5k and I only owe around £1500 on one of my cards and nothing on the other
