Left a message on voicemail for my new adjudicator...

I bet he will be fed up of me already. I rang yesterday (mind you he said to do in the letter - then I emailed the agreements - which they already had anyway but he asked me to do anyway:confused: . I also emailed the confusion too) and now have left a message for him to call me about this "goodwill offer" to see if this is full and final in regards to ANY "complaint" with the co-op then stopping me from going ahead with the other 3 loans. .

I wonder if he will get back to me.

But maxdp, my first letter of complaint was about the last loan of 2002 as they took over 7 weeks to send the agreements for the others and I wanted to get the complaint in. I then received the other agreements (was told over the phone that no PPI was added) and two weeks later wrote to the same person and said that all four were actually missold. They then wrote to me and only ackowledged my first complaint of the 2002 loan and never bothered to reply to my other letter whereby I state all four loans were missold. They said it was their final response in the matter. If i sign this then I am signing that my "complaint" with the co-op is full and final and it is not. They could then state that this settlement was in regards to my complaint letter whereby I mention all four loans and I do not want to sign for something and do myself out of £6K. You have to be very careful.

They actually state this would be in full and final settlement of "your" "complaint" and my complaint was about 4 loans. Do you see where I am coming from here.

Yes I see where you are coming from its your complaint rather than your loan. See what you mean. Complete mess isn't it. Do you get the feeling that someone up there sees your name come up at FOS and they think they will throw a spanner in the works. Hopefully they will get their finger out and sort it out.

Hi maxdp, glad you see where i am coming from here. I don't want to drop myself in it do I?? My complaint was that there was PPI on four loans with the co-op. If i accept then the wording on the ombudsman letters is that co-op are prepared to pay the following redress in full and final settlement of your "complaint" as a gesture of goodwill..

Just waiting to a response from this new one now... I hope he does get back today.

Can you help? We took out a mortgage payment protection policy with Alliance and Leicester in 1989 and were told by the salesman that we would have more protection with this policy and that we could cancel our existing life assurance policy because the new policy had a life element included.
After my husband died the family were told that the policy had no life element.
Later we tried to ask the financial ombudsman to take up my case but was told that because it was pre 1990 there was nothing they could do.
After reading that the Alliance and Leicester had a massive fine for mis selling PPIs do you think I should take it up again and if so any ideas where I could start.
I had to sell my home because I could not afford the payments and I will shortly have to move into social housing very shortly because I cannot afford to have my home any longer.
It makes me angry because I still have the original policy which would have paid off the whole of the mortgage and it was only because Alliance and Leicester lied about what was included in a policy that I have been put in this position.
My husband paid between £20 & £35 a month every month since 1989 until June 2004 and it was all for nothing.
    Please Help

    Hi again

I've looked it up a bit more and it appears that mortgage payment protection insurance is similar to the normal PPI but it doesn't usually include the life element. If you only found out about the lack of life insurance in 2004, then, I believe, the six years you have to claim should start when you discovered it. Speak to someone from Citizens Advice or a solicitor as I said in my earlier post as they will be able to let you know if anything can be done. I hope it can.

Usually mortgage protection insurance is not payable as a lump sum and cancellable at any time too.

    Wahoooo

The adjudicator has just called me and said that he understands my complaint fully now and has stated that I made a very valid statement in that accepting this offer this would be in full and final settlement and that would include the other loans too.

he has now 100% stated that all four are being looked into and that he has tried to call the co-op today but had to listen to music and answerphones etc but he is going to get back to them and when he has another offer (if they do of course) get back to me....

That is all I wanted, a fair argument and him to adjudicate. Just have to wait now and I have told him i will not pester him again.

He has emailed this as well

I have passed the information you have provided to the Co-op and I am awaiting its response. Please hold the settlement form for the present until I can confirm whether or not they are going to make goodwill gestures on the other 3 PPI sales.I am considering all four loans under the above complaint reference.
