    This was posted on DVDReviewer - a reply to Argos regarding their T&C's and the cancellation. It's a classic!

    "Dear Sir / Madam
    Referring to Condition 4.2b of your terms and conditions it clearly states that you would contact me to "reconfirm my order at the correct price or cancelling it", from the email received this afternoon I have not been given either option nor have I been uncontactable. At no point have I said that I wish to cancel my order and so cannot see on what grounds condition 2.3 comes into it.


    4.2 The price you pay is the price displayed on this website at the time we receive your order apart from the following two exceptions:
    a) For products reserved online for store pick up or any other reservation service the price you pay is the price in store on the day of collection.
    b) While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.


    I look forward to your reply at your earliest convinence.

    Seeing they are relying on sect 2.3 of their t&c's it all hinges on whether taking the money off our c/c's is deemed acceptance, in law. If it was a high street shop it would be, online its a grey area until it goes to court.

    I agree, and i also agree a case needs to go to court to make this grey area clear.
    I just think the danger of taking this to court is that it would be laughed straight back out of court.
    If the price had been £49 then maybe, but not 49p.

    I think you will find that if they win they will claim their fees from the other side, this was certainly the case when household policy provided legal representative in my wifes case against her employer, they will only take on a case where they feel there is a greater than 50% chance of winning.

    The point is, even if the solicitors advise legal insurers that there are reasonable prospects of success, the insurers will then look at all of the relevant circumstances surrounding the case and make their own decision whether or not to proceed with it to court. I know, because I've been there. I had a case over a garage door that cost about 380 quid and the legal insurers decided just to pay me the 380 quid for a new door rather than take the matter to court and take the chance that they would lose.

    My question.

    I ordered one at the weekend. Monday Argos tell the tabloids that they know about it and everyone has been told they will not get tellies. (not me though and no-one else here.)

    This afternoon - 48hrs ish after Argos/Homebase knew about this problem, they have finally taken the £5.44 from my account (they hadn't at 10am this morning!!)

    Why are they taking money form tv's they know are priced wrongly and have claimed they have already told me I'm not getting???

    I am not expecting to get one, but under these pathetic circumstances I am going to argue the point and see what I get (probably an extended phone call!!!)

    I ordered days ago the money was taken form accounts days ago yet only tonight after close of business do they send me an email cancelling my orders telling em they will refund my money soon. I have replied saying that I do not thinkj this is good enough and that as they took the money from my account (not reserved it) than they should either honour the order or at least offer some form of goodwill geature especially as they still have MY money.
