  • Just got the Argos email just now. Didn't do the Homebase one.
    If I had known then what I know now . . .

I wonder (in the strange & curious world of Argos) what their idea of "as soon possible" is when it comes to returning the £5.44s that we have all lent them interest-free for the last day or so????

I'm authorising my union to take this to court now as I feel principles are at stake . If it only gets a definition over what companies are/aren't allowed to do once payment has been taken then that is all I require .

Your union will not pursue this, I can guarantee you. As with all legal insurances, you will have to show that you have reasonable prospects of success before they will be willing to outlay huge sums of money in solicitors and court fees.

If you're lucky they will send a letter to Argos/Homebase on your behalf, but when Argos refuse to budge (which they will), the insurers will refuse to fund the matter any further. It would actually be cheaper for the insurers to buy you the TV from Argos/Homebase at the correct price rather than pursue the matter through the courts. It all comes down to money at the end of the day.

If I'm wrong and they do pursue it, please feel free to say "I told you so", but I'll be VERY surprised if they do.

I think all the talk of legal action will fall on deaf ears.

What i would say is, i think this 'misprice' isn't as innocent as many people think.

Perhaps if people decide not to spend their money at Argos or Homebase in future and bought elsewhere (not going to make a major difference but perhaps a little one). This may make them think twice before advertising goods and misleading possible customers.

well ive been on the phone to my legal people through my house insurance and have explained the situation and they are sending out forms and are going to pursue it. This could get rather interesting.

You must be the Invisible Man because I never saw you in the same room as my union legal chappie when he said he would pursue it . For your information as well , my union does not employ legal insurers , they have their own legal department with relevant lawyers with the backing of the union banking fund who are paid a salary , NOT £100's per hour . The principle is now of
    e-commerce standards , NOT the provision of 49p TV's .
  • blimey, this all gets a bit far fetched.

I think you will find that if they win they will claim their fees from the other side, this was certainly the case when household policy provided legal representative in my wifes case against her employer, they will only take on a case where they feel there is a greater than 50% chance of winning.
